offering a managed care plan for which a certificate of authority is
required become a member of a guaranty association by the year 2005.

S1143|||| LEGISLATURE OF THE STATE OF IDAHO |||| Fifty-fifth Legislature First Regular Session - 1999IN THE SENATE SENATE BILL NO. 1143 BY COMMERCE AND HUMAN RESOURCES COMMITTEE 1 AN ACT 2 RELATING TO THE MANAGED CARE REFORM ACT; AMENDING SECTION 41-3931, IDAHO CODE, 3 TO REQUIRE THAT EACH ORGANIZATION OFFERING A MANAGED CARE PLAN FOR WHICH A 4 CERTIFICATE OF AUTHORITY IS REQUIRED BECOME A MEMBER OF A GUARANTY ASSOCI- 5 ATION BY THE YEAR 2005. 6 Be It Enacted by the Legislature of the State of Idaho: 7 SECTION 1. That Section 41-3931, Idaho Code, be, and the same is hereby 8 amended to read as follows: 9 41-3931. PARTICIPATION IN GUARANTY ASSOCIATION BY THE YEAR 2000105 . (1) By the conclusion of the year 200011 5 , each organization offering a managed care plan for which a certifi- 12 cate of authority is required under this chapter shall, as a condition of its 13 authority to continue to offer managed care plans in this state, become a mem- 14 ber of a guaranty association having as its purpose the protection of all mem- 15 bers of the managed care organization in this state against failure by the 16 organization in the performance of its obligations due to impairment or insol- 17 vency. 18 (2) The director may take such actions and promulgate such rules as may 19 be necessary to effectuate the provisions of this section.
STATEMENT OF PURPOSE
RS 0877/
The passage of tbe Managed Care Reform Act in 1997 required tbat managed care
organizations be a member of a guaranty association by January 1, 2000. There are no
clear solutions to tbis requirement at this time. This amendment delays tbe requirement
tbat managed care organizations be a member of a guaranty association for five years.
FISCAL NOTE
There is no fiscal impact to tbe General Fund or to dedicated fimds.
