                               BY TRANSPORTATION COMMITTEE

 1                                        AN ACT
 2    RELATING TO REGISTRATION OF MOTOR VEHICLES;  AMENDING  SECTION  31-870,  IDAHO
 3        CODE,  TO  PROVIDE THAT THE ANNUAL ADMINISTRATIVE FEE COLLECTED FOR REGIS-
 4        TRATION OF A MOTOR VEHICLE SHALL BE THE SAME FOR A VEHICLE WHICH IS REGIS-
 5        TERED FOR A TWO-YEAR PERIOD; AMENDING CHAPTER 4, TITLE 49, IDAHO CODE,  BY
 6        THE  ADDITION  OF A NEW SECTION 49-402B, IDAHO CODE, TO PROVIDE THE OPTION
 7        OF REGISTERING CERTAIN MOTOR VEHICLES FOR A PERIOD OF TWO YEARS;  AMENDING
 8        SECTION 49-452, IDAHO CODE, TO PROVIDE THAT THE EMERGENCY MEDICAL SERVICES
 9        FEE SHALL BE DOUBLED FOR MOTOR VEHICLES REGISTERED UNDER THE PROVISIONS OF
10        SECTION 49-402B, IDAHO CODE; AND PROVIDING AN EFFECTIVE DATE.

11    Be It Enacted by the Legislature of the State of Idaho:

12        SECTION  1.  That  Section  31-870, Idaho Code, be, and the same is hereby
13    amended to read as follows:

14        31-870.  FEES FOR COUNTY SERVICES. (1) Notwithstanding any other provision
15    of law, a board of county commissioners may impose and collect fees for  those
16    services  provided by the county which would otherwise be funded by ad valorem
17    tax revenues. The fees collected pursuant to this section shall be  reasonably
18    related  to,  but  shall not exceed, the actual cost of the service being ren-
19    dered.  Taxing districts other than counties may impose fees for  services  as
20    provided in section 63-1311, Idaho Code.
21        (2)  The  board  of county commissioners may establish and provide for the
22    collection of a solid waste fee in accordance with a request made pursuant  to
23    this section, and such fee shall be certified and collected in the same manner
24    provided by law for the collection of real or personal property taxes.
25          (3)  The administrative fee authorized under the provisions of this
26    section and collected for issuance of motor vehicle registrations pursuant  to
27    chapter 4, title 49, Idaho Code, shall be the same for any registration issued
28    pursuant  to section 49-402B, Idaho Code, and may not be doubled or in any way
29    increased solely because of registration under that section. 

30        SECTION 2.  That Chapter 4, Title 49, Idaho Code,  be,  and  the  same  is
31    hereby  amended  by  the addition thereto of a  NEW SECTION , to be
32    known and designated as Section 49-402B, Idaho Code, and to read as follows:

33        49-402B.  OPTIONAL BIENNIAL REGISTRATION. (1)  At the option of the appli-
34    cant, any vehicle registered under the provisions of section 49-402(1) through
35    (5), Idaho Code, may be registered for a period of two (2)  years  for  a  fee
36    that is double the fee currently assessed for annual registration of the vehi-
37    cle in section 49-402, Idaho Code.
38        (2)  If  any  vehicle  registered under a special license plate program is
39    registered for a two (2) year period as provided in this section,  the  regis-
40    trant  shall  also  be required to pay the special programs fees for a two (2)
41    year period.

 1        (3)  The additional fee collected for emergency medical services  pursuant
 2    to  section  49-452,  Idaho  Code,  shall also be doubled for any registration
 3    issued under the provisions of this section.
 4        (4)  The administrative fee collected for issuance of a motor vehicle reg-
 5    istration shall be the same as for an annual registration  and  shall  not  be
 6    doubled  or in any way increased solely because of registration under the pro-
 7    visions of this section.

 8        SECTION 3.  That Section 49-452, Idaho Code, be, and the  same  is  hereby
 9    amended to read as follows:

10        49-452.  EMERGENCY  MEDICAL  SERVICES  FEE.  (1)   An emergency
11    medical services fee of one dollar and twenty-five cents ($1.25) shall be col-
12    lected in addition to each motor vehicle  registration  fee  amount  collected
13    under  the  provisions  of  this chapter, with the exception of those vehicles
14    proportionally registered under section 49-435, Idaho Code. Twenty-five  cents
15    ($.25)  of  the  fee  shall  be retained by the county of residence for use in
16    funding local emergency medical service costs. One dollar ($1.00) of  the  fee
17    shall be transmitted to the state treasurer for deposit in the emergency medi-
18    cal services account established in section 39-146, Idaho Code.
19          (2)  For  vehicles  registered  under  the  provisions  of  section
20    49-402B,  Idaho  Code,  the  fee shall be two dollars and fifty cents ($2.50).
21    Fifty cents ($.50) of the fee shall be retained by the county of residence for
22    use in funding local emergency medical services costs. Two dollars ($2.00)  of
23    the  fee  shall be transmitted to the state treasurer for deposit in the emer-
24    gency medical services account established  in  section  39-146,  Idaho  Code.
25    

26        SECTION  4.  This act shall be in full force and effect on and after Janu-
27    ary 1, 2000.

Statement of Purpose / Fiscal Impact


                       STATEMENT OF PURPOSE

This legislation will allow, at tax option of the applicant,
vehicle registration for a period of 2 years. Administrative
fees collected shall be the same as for an annual registration.

                            FISCAL NOTE

No impact on general fund. Minimum impact on registration
revenues since fee remains the same. Positive advantage because
revenue for second year received earlier than under current
code. Additional minor administrative savings because of reduced
paper work. With an optional two year registration program, the
registrant would save postage and administration fees on the
second year. Administration fees vary from county to county and
