 1                                        AN ACT
 2    RELATING TO SPECIAL MOTOR VEHICLE LICENSE  PLATES;  AMENDING  SECTION  49-402,
 3        IDAHO  CODE, TO PROVIDE CORRECT REFERENCES AND TO CLARIFY DEPOSIT OF REVE-
 4        NUES FROM SPECIAL LICENSE PLATE PROGRAMS; AMENDING CHAPTER  4,  TITLE  49,
 5        IDAHO  CODE,  BY  THE  ADDITION  OF  A NEW SECTION 49-419A, IDAHO CODE, TO
 6        ESTABLISH AN IDAHO SAWTOOTH NATIONAL RECREATION AREA  LICENSE  PLATE  PRO-
 7        GRAM; AND PROVIDING AN EFFECTIVE DATE.

 8    Be It Enacted by the Legislature of the State of Idaho:

 9        SECTION  1.  That  Section  49-402, Idaho Code, be, and the same is hereby
10    amended to read as follows:

11        49-402.  ANNUAL REGISTRATION. (1) The annual fee for operating each pickup
12    truck and each other motor vehicle having a maximum gross weight not in excess
13    of eight thousand (8,000) pounds, designed for the purpose of carrying passen-
14    gers and not used for hire shall be:
15        Vehicles one (1) and two (2) years old ............................ $48.00
16        Of the registration fees collected for vehicles one (1) and two (2)  years
17        old,  $36.48  shall  be  deposited to the highway distribution account and
18        $11.52 shall be deposited to the restricted highway fund.
19        Vehicles three (3) and four (4) years old ......................... $36.00
20        Of the registration fees collected for vehicles three  (3)  and  four  (4)
21        years  old,  $33.48 shall be deposited to the highway distribution account
22        and $2.52 shall be deposited to the restricted highway fund.
23        Vehicles five (5) and six (6) years old ........................... $36.00
24        Of the registration fees collected for vehicles five (5) and six (6) years
25        old, $26.28 shall be deposited to the  highway  distribution  account  and
26        $9.72 shall be deposited to the restricted highway fund.
27        Vehicles seven (7) and eight (8) years old ........................ $24.00
28        Of  the  registration  fees collected for vehicles seven (7) and eight (8)
29        years old, $22.68 shall be deposited to the highway  distribution  account
30        and $1.32 shall be deposited to the restricted highway fund.
31        Vehicles over eight (8) years old ................................. $24.00
32        Of  the registration fees collected for vehicles over eight (8) years old,
33        $16.08 shall be deposited to the highway distribution  account  and  $7.92
34        shall be deposited to the restricted highway fund.
35        There  shall  be twelve (12) registration periods, starting in January for
36    holders of validation registration stickers numbered 1, and proceeding consec-
37    utively through December for holders of validation registration stickers  num-
38    bered  12,  each of which shall start on the first day of a calendar month and
39    end on the last day of the twelfth month from the first day of  the  beginning
40    month.  Registration periods shall expire midnight on the last day of the reg-
41    istration period  in  the  year  designated  by  the  validation  registration
42    sticker.  The  numeral digit on the validation registration stickers shall, as
43    does the registration card, fix the registration period  under  the  staggered

 1    plate  system of Idaho for the purpose of reregistration and notice of expira-
 2    tion.
 3        A vehicle that has once been registered for any of  the  above  designated
 4    periods   shall, upon reregistration, be registered for the period bearing the
 5    same number, and the registration card shall show and be the  exclusive  proof
 6    of  the  expiration  date  of registration and licensing. Vehicles may be ini-
 7    tially registered for less than a twelve (12) month period, or for more than a
 8    twelve (12) month period, and the fee prorated on a monthly basis if the frac-
 9    tional registration tends to fulfill the purpose of the monthly series  regis-
10    tration system.
11        (2)  For all motor vehicles equipped to carry passengers and operated pri-
12    marily  for  hire  exclusively  within  the limits of an incorporated city and
13    adjacent thereto, when the service outside the city is a  part  of  a  regular
14    service  rendered  inside  the city, and for school buses operated either by a
15    nonprofit, nonpublic school or operated pursuant to a service contract with  a
16    school  district  for transporting children to or from school or in connection
17    with school approved activities, the annual fee shall be  twelve  dollars  and
18    forty-eight cents ($12.48).
19        (3)  For  all  hearses,  ambulances  and  wreckers the annual fee shall be
20    twenty-nine dollars and forty cents ($29.40), and these  vehicles  shall  bear
21    passenger  car plates. No operator of a hearse, ambulance, or wrecker shall be
22    entitled to operate them by virtue of any dealer's license that may have  been
23    issued under the provisions of this chapter.
24        (4)  For all motorcycles and  all-terrain vehicles the annual fee shall be
25    nine dollars ($9.00). For operation of an ATV off the public highways, the fee
26    specified  in  section  67-7122,  Idaho Code, shall also be paid. Registration
27    exemptions provided in section 49-426(2), Idaho  Code,  apply  to  all-terrain
28    vehicles  and  motorcycles  used for the purposes described in that subsection
29    (2).
30        (5)  For all motor homes the fee shall be as specified in  subsection  (1)
31    of  this  section and shall be in addition to the fees provided for in section
32    49-445, Idaho Code.
33        (6)  Registration fees shall not be subject to refund.
34        (7)  A financial institution  or  repossession  service  contracted  to  a
35    financial  institution  repossessing  vehicles  under  the terms of a security
36    agreement shall move the vehicle from the place of repossession to the  finan-
37    cial institution's place of business on a repossession plate. The repossession
38    plate  shall  also be used for demonstrating the vehicle to a prospective pur-
39    chaser for a period not to exceed ninety-six (96) hours. The registration fees
40    for repossession plates shall be as required in subsection (1) of this section
41    for a vehicle one (1) and two (2) years old. All  other  fees  required  under
42    chapter 4, title 49, Idaho Code, shall be in addition to the registration fee.
43    The repossession plate shall be issued on an annual basis by the department.
44        (8)  In  addition  to  the  annual registration fee in this section, there
45    shall be an initial program fee of twenty-five dollars ($25.00) and an  annual
46    program fee of fifteen dollars ($15.00) for all special license plate programs
47    for  those license plates issued pursuant to sections 49-404A, 49-407, 49-408,
48    49-409, 49-414,  49-416 and 49-418, Idaho Code. For special plates issued pur-
49    suant to sections 49-406 and 49-406A, Idaho Code, there shall  be  an  initial
50    program  fee  of  twenty-five  dollars  ($25.00)  but there shall be no annual
51    renewal fee. For special plates issued  pursuant  to  sections  49-417  ,
52        and    49-417A,   49-419, 49-419A and 49-420, 
53    Idaho Code, there shall be an  initial  program  fee  of  thirty-five  dollars
54    ($35.00)  and an annual program fee of twenty-five dollars ($25.00).  For
55    special plates issued pursuant to section 49-418A,  Idaho  Code,  the  initial

 1    program fee and the annual renewal fee shall be fifty dollars ($50.00). 
 2    The  fees  contained in this subsection shall be applicable to all new special
 3    plate programs. The initial program fee and the annual program  fee  shall  be
 4    deposited    in  the  state highway account and shall be used to fund the
 5    cost of administration of special license plate programs which are provided to
 6    the public as a personal alternative to the standard  license  plate  require-
 7    ments   as specified by law for each program .

 8        SECTION  2.  That  Chapter  4,  Title  49, Idaho Code, be, and the same is
 9    hereby amended by the addition thereto of a  NEW SECTION  ,  to  be
10    known and designated as Section 49-419A, Idaho Code, and to read as follows:

11        49-419A.  IDAHO  SAWTOOTH  NATIONAL  RECREATION  AREA  PLATES. (1)  On and
12    after January 1, 2000, any person who is the owner  of  a  vehicle  registered
13    under  the  provisions  of section 49-402, Idaho Code, or registered under any
14    other section of law for which the purchase of special plates is allowed,  may
15    apply for and upon department approval receive Idaho sawtooth national  recre-
16    ation area license plates in lieu of regular license plates. The provisions of
17    this  section  shall  not apply to any vehicle with a registered maximum gross
18    weight over sixteen thousand (16,000) pounds. Availability of  Idaho  sawtooth
19    national  recreation  area  plates  for other vehicles shall be subject to the
20    rules, policies and procedures of the department.
21        (2)  In addition to the regular registration fees required in  chapter  4,
22    title 49, Idaho Code, the applicant shall be charged a fee of thirty-five dol-
23    lars  ($35.00) for the initial issuance of the plates, and twenty-five dollars
24    ($25.00)  upon  each  succeeding  annual  registration.  Twenty-five   dollars
25    ($25.00)  of  the  initial fee and fifteen dollars ($15.00) of the renewal fee
26    shall be deposited in the state highway account and shall be used to fund  the
27    cost  of  administration  of  this  special license plate program. Ten dollars
28    ($10.00) of each initial fee and ten dollars  ($10.00)  of  each  renewal  fee
29    shall  be  deposited  by  the  state treasurer in the park and recreation fund
30    established in section 67-4225, Idaho Code, for  use  in  the  maintenance  of
31    parks  and facilities. This fee shall be treated as a contribution to the out-
32    door recreation program and shall not be considered a motor vehicle  registra-
33    tion  fee  as described in section 17, article VII, of the constitution of the
34    state of Idaho.
35        (3)  Whenever title or interest in a vehicle registered under  the  provi-
36    sions  of  this section is transferred or assigned, the owner may transfer the
37    special plates to another vehicle upon payment of the required transfer  fees.
38    The  owner  may only display the plates on another vehicle upon receipt of the
39    new registration from the department.
40        (4)  The Idaho sawtooth national  recreation  area  license  plate  design
41    shall  be  of  a color and design in accordance with the provisions of section
42    49-402C, Idaho Code. That portion of  the  design  which  features  the  Idaho
43    sawtooth  national recreation area shall be acceptable to the sawtooth society
44    and shall be approved by the department utilizing a numbering system as deter-
45    mined by the department. Initial costs of the  plate  program,  including  the
46    cost of the plate design, shall be paid by the sawtooth society.
47        (5)  Sample  Idaho  sawtooth  national  recreation area plates may be pur-
48    chased from the department for a fee of thirty dollars ($30.00),  twelve  dol-
49    lars  ($12.00)  of  which  shall be deposited in the state highway account and
50    eighteen dollars ($18.00) of which shall be deposited by the  state  treasurer
51    in the park and recreation fund for use in the maintenance of parks and facil-
52    ities. No additional fee shall be charged for personalizing sample plates.

 1        SECTION  3.  This act shall be in full force and effect on and after Janu-
 2    ary 1, 2000.

Statement of Purpose / Fiscal Impact


                       STATEMENT OF PURPOSE

                             RS09028

The purpose of this proposed legislation is to allow owners of
registered motor vehicles to voluntarily contribute funds by
participating in a Special License Plate Program to be utilized by
the Sawtooth Society for maintaining and upgrading outdoor
recreation facilities within the Sawtooth National Recreation Area. 
Such maintenance and upgrades will be for motorized and
non-motorized trails, camping facilities, bridges, restrooms,
parking areas, roads, boat launch facilities, and boat docks. The
Sawtooth Society will be on a reimbursement basis for the purposes
of meeting the objectives of the state trails plan, state boating
plan, or state comprehensive outdoor recreation and tourism plan
within the SNRA.  The excess funds generated by the sale of the
license plates will be deposited in the parks and recreation fund
and will be administered by the Dept. of Parks and Recreation.







                           FISCAL NOTE


This proposed legislation will have no negative impact on the
general fund or other state or local budgets.  Moneys received from
the sale of these license plates will cover costs associated with
the special plate program.
