                           SENATE CONCURRENT RESOLUTION NO. 130

                                   BY FINANCE COMMITTEE

 1                               A CONCURRENT RESOLUTION
 2    AUTHORIZING THE DEPARTMENT OF PARKS AND RECREATION TO  ENTER  INTO  AGREEMENTS
 3        WITH  THE  IDAHO  STATE BUILDING AUTHORITY TO FINANCE AND ACQUIRE PROPERTY
 4        FOR A NEW STATE PARK IN BOX SPRINGS CANYON NEAR HAGERMAN, IDAHO.

 5    Be It Resolved by the Legislature of the State of Idaho:

 6        WHEREAS, Governor Batt and the Earl Hardy Foundation executed  a  purchase
 7    and  sales  agreement on December 31, 1998, providing for acquisition by Idaho
 8    Department of Parks and Recreation of certain unique  property  located  along
 9    the Snake River in an area known as Box Springs Canyon near Hagerman, Idaho;
10        WHEREAS,  the  Idaho  Nature Conservancy has agreed to assist the state in
11    the acquisition of such land; and
12        WHEREAS, such acquisition of the land for use as a new state  park  is  in
13    the public interest; and
14        WHEREAS,  the  Idaho  State  Building  Authority  is empowered to acquire,
15    finance and provide facilities to the state of Idaho.
16        NOW, THEREFORE, BE IT RESOLVED by the members of the First Regular Session
17    of the Fifty-fifth Idaho Legislature, the Senate and the House of  Representa-
18    tives  concurring therein, that the Legislature hereby authorizes and provides
19    approval for the Department of Parks and Recreation to enter into an agreement
20    or agreements with the Idaho State Building Authority, under  such  terms  and
21    conditions  as  may  be reasonable and necessary, to provide financing for the
22    acquisition of such property and to make such property available  for  use  by
23    the Department of Parks and Recreation.
24        BE  IT  FURTHER  RESOLVED  that  this Resolution constitutes authorization
25    required by the provisions of Section 67-6410, Idaho Code.

Statement of Purpose / Fiscal Impact


                       STATEMENT OF PURPOSE

                             RS 09152

This Concurrent Resolution authorizes the Department of Parks
and Recreation to enter into agreements with the State Building
Authority to finance and acquire property for the state at Box
Springs Canyon near Hagerman, Idaho. A purchase agreement was
worked out between Governor Batt and the Earl Hardy Foundation
to acquire this beautiful and unique property along the Snake
River for the sum of five million dollars.

                   FISCAL NOTE (revised 3/2/99)

There is no impact to the General Fund. The sources of funding
for this five million dollar purchase will come from the
following sources.

                                                  1.   Five Hundred Thousand Dollars ($500,000) from the Idaho
     Power Company 401 Water Quality Consent Agreement:

                                                    2.   Eight Hundred Ninety Thousand Dollars ($890,000) from the
     INEEL settlement fund (Pit 9).

                                                    3.   One Million One Hundred ten Thousand Dollars ($1,110,000)
     from the Nature Conservancy; and

                                                 4.   Two Million Five Hundred Thousand Dollars ($2,500,000)
     from the Idaho State Building Authority.

The $2.5 million from the Building Authority and $1.11 million
from the Nature Conservancy are bridge funding that will be
repaid. The $2.5 million from the Building Authority will be
reimbursed from monies the State will receive under the Idaho
Power Company 401 Water Quality Consent Agreement upon
relicensing of the Company's mid-Snake projects. The Nature
Conservancy will be reimbursed with monies from the Land and
Water Conservation Fund. Both the Building Authority and the
Nature Conservancy will hold title to the property as tenants-in-common as security for repayment. Upon repayment, each
entity will convey its interest in the property to the Idaho
Department of Parks and Recreation.
