                              SENATE JOINT MEMORIAL NO. 103

                             BY JUDICIARY AND RULES COMMITTEE

 1                                   A JOINT MEMORIAL
 2    TO THE PRESIDENT OF THE UNITED STATES, TO THE SENATE AND HOUSE OF  REPRESENTA-
 3        TIVES OF THE UNITED STATES IN CONGRESS ASSEMBLED, AND TO THE CONGRESSIONAL
 4        DELEGATION  REPRESENTING  THE STATE OF IDAHO IN THE CONGRESS OF THE UNITED
 5        STATES.

 6        We, your Memorialists, the Senate and the House of Representatives of  the
 7    State of Idaho assembled in the First Regular Session of the Fifty-fifth Idaho
 8    Legislature, do hereby respectfully represent that:

 9        WHEREAS,  an  economic  emergency  has  been  created by ongoing depressed
10    prices in the marketplace for agricultural products and we believe a  contrib-
11    uting  factor  to the depressed prices is the North American Free Trade Agree-
12    ment as administered; and
13        WHEREAS, an investigation into the causes of the depressed prices is  war-
14    ranted  and  actions  should  be initiated to stabilize the nation's food pro-
15    ducers, main street businesses and rural America; and
16        WHEREAS, the North American Free Trade Agreement as  negotiated  does  not
17    meet  the  test  of a free, fair trade agreement particularly with the lack of
18    enforcement of some of  the  provisions  of  the  Agreement  by  some  of  our
19    country's trading partners; and
20        WHEREAS,  the  North  American Free Trade Agreement has adversely affected
21    Idaho's agriculture by allowing Mexico to flood U.S. markets with cheap sugar,
22    unfairly competing with Idaho's sugar beet industry and  by  allowing  Mexican
23    commodities  produced  with  pesticides banned in the United States to compete
24    with Idaho's agricultural producers whose pesticide use is regulated; and
25        WHEREAS, the United States Congress needs to take actions that will stabi-
26    lize the nation's food producers, main street businesses and rural America  as
27    a  whole including looking at emergency price supports and a safety net system
28    for all agricultural products to be lifted only when international and  domes-
29    tic  markets are reformed in a way that renders them open, public and competi-
30    tive; and
31        WHEREAS, Congress and the  Administration  need  to  explore  avenues  for
32    expansion  and development of new international markets for agricultural prod-
33    ucts and ensure that agricultural producers have advisory status at any  agri-
34    cultural trade negotiations with a priority on price transparency of the Cana-
35    dian Wheat Board.
36        NOW, THEREFORE, BE IT RESOLVED by the members of the First Regular Session
37    of  the Fifty-fifth Idaho Legislature, the Senate and the House of Representa-
38    tives concurring therein, that Congress and the President  are urged  to  pro-
39    vide  that  the  provisions  of  the  North  American  Free Trade Agreement be
40    enforced  or that the Agreement be nullified and the United  States  withdrawn
41    from the provisions of and participating in  the Agreement.
42        BE  IT  FURTHER  RESOLVED  that the Secretary of the Senate be, and she is
43    hereby authorized and directed to forward a copy of this Memorial to the Pres-
44    ident of the United States, the President of the Senate and the Speaker of the

 1    House of Representatives of Congress, and the congressional delegation  repre-
 2    senting the state of Idaho in the Congress of the United States.
