 1                                        AN ACT
 2    RELATING TO THE LIBRARY IMPROVEMENT ACCOUNT; AMENDING SECTION  33-2506,  IDAHO
 3        CODE,  TO  CHANGE THE NAME OF THE ACCOUNT, TO REDEFINE POLICY AND PURPOSE,
 4        TO PROVIDE FOR APPROPRIATIONS AND REVENUES AND  TO  PROVIDE  FOR  PAYMENTS
 5        FROM THE FUND.

 6    Be It Enacted by the Legislature of the State of Idaho:

 7        SECTION  1.  That  Section 33-2506, Idaho Code, be, and the same is hereby
 8    amended to read as follows:

 9        33-2506.  LIBRARY  SERVICES  IMPROVEMENT   ACCOUNT  
10      FUND  -- ESTABLISHED. (1)  Policy.  The state of Idaho
11    recognizes its responsibility to provide  public  library  services
12    to    its citizens   people  in  both the urban and
13    rural   all  areas of the state.  The  state    realizes
14    that  many  citizens  of the state receive few library services. Some citizens
15    receive no library services at all. Therefore,  there  is  established  
16      acknowledges that the ability of each Idahoan to access information has
17    a critical impact on the state's economic  development,  educational  success,
18    provision  for  an informed electorate, and overall quality of life. Realizing
19    that libraries of all types and in all parts of the  state  must  be  able  to
20    interact  and  cooperate in order to respond to these informational needs, the
21    state of Idaho hereby creates and establishes  in the state treasury the
22    library  services  improvement    account      fund
23    .    The library improvement account shall have paid into it appro-
24    priations or revenues as may be provided by law. 
25        (2)   Purpose. The purpose of the library services  improvement  fund
26    is to further the development of library services for all the people of Idaho.
27      Moneys  in the library  services  improvement  account
28      fund  are appropriated to and may be expended by the  state
29    library board at any time for the purposes provided in this section.
30        (3)    (a)  The  board  of trustees of any tax-supported city or dis-
31        trict library may apply to the state library board to receive a payment or
32        payments from the library improvement  account.   Provided  however,  they
33        must  demonstrate  to  the  state library board that their community has a
34        substantial and serious need to have improved library services or  a  need
35        to expand library services to adjacent rural areas. 
36          (b)  When an application for moneys from the account is approved by
37        the state library board, the state librarian  shall  inform  the  applying
38        library that the application has been approved, citing the amount approved
39        for  payment  and an estimate of the time when the payment can actually be
40        made to the applying library. 
41         Appropriations and revenues. The library services  improvement  fund
42    shall have paid into it such appropriations as may be provided or other moneys
43    and donations described in section 33-2503, Idaho Code.

 1        (4)   Payments.
 2        (a)    All  payments from the library  services  improve-
 3        ment  account   fund  shall be paid    directly
 4        to the library   out  in warrants drawn by the state con-
 5        troller upon presentation of proper vouchers from the state library. Pend-
 6        ing  payments  out  of the library  services  improvement 
 7        account   fund , the moneys in the   account  
 8          fund    shall  be invested by the state treasurer in the same
 9        manner as provided under section 67-1210, Idaho Code, with respect to idle
10        moneys in the state treasury. Interest earned on the investments shall  be
11        returned  to  the  library  services  improvement  account
12          fund .
13        ( 5  b )  No  tax-supported  city  or  district
14          library    entity    is automatically entitled to 
15        receive   any  payments  from  the  library    services  
16        improvement  account, but must demonstrate to the state library board
17        an  actual need for payment as set forth in subsection (3)(a) of this sec-
18        tion   fund . The state library board shall establish the
19        criteria upon which actual need is to be determined    in  accordance
20        with  the  purposes  set  forth  in  this  section .  The state
21        library board shall give priority to projects which will  improve  library
22        services in a community or expand library services into the rural areas of
23        the state. 
24        (  6   c )  Payments from the library  services
25         improvement  account received by a library     fund
26         may be used  by the library  only for the purposes 
27        stated  in  the application as  approved by the state library board.
28         Funding decisions shall be solely within the discretion of the state
29        library board.

                      STATEMENT  OF  PURPOSE

This amendment will expand the benefits of the Library Services
Improvement Fund from just public libraries to all types of
libraries, including school, academic, and special.

The State Library is entering into activities such as statewide
database licensing, document delivery, resource sharing, and
literacy programs.  Amending 33-2506 will allow funds from all
sources to be deposited to the fund and disbursed as appropriate
and in a timely fashion. Funds could be disbursed to all types of
libraries and for multi-type cooperative projects.


FISCAL  IMPACT

There is no immediate fiscal impact on the general fund.  The LSI
Fund does collect interest.
