 1                                        AN ACT
 2    RELATING TO THE INDUSTRIAL SPECIAL INDEMNITY FUND; AMENDING SECTION 2, CHAPTER
 3        303, LAWS OF 1997, TO CONTINUE SECTION 72-334, IDAHO CODE, IN EFFECT UNTIL
 4        JUNE 30, 2004.

 5    Be It Enacted by the Legislature of the State of Idaho:

 6        SECTION 1.  That Section 2, Chapter 303, Laws of 1997, be, and the same is
 7    hereby amended to read as follows:

 8        SECTION 2.  Section 1 of this act shall be in full force and effect on and
 9    after July 1, 1997, and shall be null, void, and of no force and effect on and
10    after June 30,  1999   2004 .

Statement of Purpose / Fiscal Impact


                      STATEMENT  OF  PURPOSE
RS08449
Idaho Code  72-334, which became effective July 1, 1997, mandates
that before filing a complaint for benefits from the Industrial
Special Indemnity Fund (Fund), a claimant must provide materials to
the Fund manager for evaluation of the merits of the claim. This
evaluation process allows for and has resulted in the resolution of
many claims by means of an approval or settlement and has helped
avoid the need for claimants having to file a complaint against the
Fund with the Industrial Commission. The Fund's Calendar Year
1997/Fiscal Year 1998 report reflects a substantial decrease in
litigation expenses believed directly related to the evaluation
process mandated by Idaho Code  72-334.     

When initially enacted, the legislation provided for a sunset date
of June 30, 1999 for Idaho Code  72-334. This legislation extends
the sunset clause to June 30, 2004. 
FISCAL  IMPACT
Funding for the Industrial Special Indemnity Fund is provided by
sureties and self-employers as a matter of law.  Thus, there will
be no fiscal impact on the General Fund.  It is anticipated that
the Fund will continue to recognize additional savings as a result
of decreased litigation costs.
