|||| LEGISLATURE OF THE STATE OF IDAHO |||| Fifty-fifth Legislature First Regular Session - 1999 IN THE HOUSE OF REPRESENTATIVES HOUSE BILL NO. 205 BY JUDICIARY, RULES AND ADMINISTRATION COMMITTEE 1 AN ACT 2 RELATING TO TRESPASS; AMENDING CHAPTER 70, TITLE 18, IDAHO CODE, BY THE ADDI- 3 TION OF A NEW SECTION 18-7006, IDAHO CODE, TO ESTABLISH THE CRIME OF TRES- 4 PASS OF PRIVACY. 5 Be It Enacted by the Legislature of the State of Idaho: 6 SECTION 1. That Chapter 70, Title 18, Idaho Code, be, and the same is 7 hereby amended by the addition thereto of a NEW SECTION , to be 8 known and designated as Section 18-7006, Idaho Code, and to read as follows: 9 18-7006. TRESPASS OF PRIVACY. It shall be unlawful for any person, upon 10 the private property of another, to intentionally look, peer or peek in the 11 door, window, or other transparent opening of any inhabited building or other 12 structure located thereon, without visible or lawful purpose. Any person who 13 violates the provisions of this section shall be guilty of a misdemeanor.
STATEMENT OF PURPOSE RS 08617C2 The purpose of this legislation is to establish the crime of trespass of privacy. Currently, Idaho Code 18-7006 which defines the crime of trespass, offers no protection to citizens who have not posted their property with signs or markers. This new section would protect citizens from those who would come upon private property and peer into occupied residences without lawful purpose. FISCAL NOTE The fiscal impact of this new section would be minimal. Counties and municipalities would be responsible for additional prosecutions and potential incarcerations that would result from the new statute. These costs could be offset by the collection of fines. Fiscal impact would depend greatly on the discretion of judges and attorneys involved in the cases.
