                            HOUSE CONCURRENT RESOLUTION NO. 18

                         BY RESOURCES AND CONSERVATION COMMITTEE

 1                               A CONCURRENT RESOLUTION
 2    STATING FINDINGS OF THE LEGISLATURE AND REJECTING CERTAIN RULES OF  THE  IDAHO
 3        FISH  AND  GAME  COMMISSION  RELATING  TO  MANDATORY  DEER  AND ELK REPORT
 4        REQUIREMENTS AND THE USE OF DOGS.

 5    Be It Resolved by the Legislature of the State of Idaho:

 6        WHEREAS, the Legislature is vested  with  authority  to  reject  executive
 7    agency rules under the provisions of Section 67-5291, Idaho Code, in the event
 8    that  the Legislature finds that the rules are not consistent with legislative
 9    intent; and
10        WHEREAS, it is the finding of the Legislature that certain  rules  of  the
11    Idaho  Fish  and  Game  Commission  relating  to mandatory deer and elk report
12    requirements and the use of dogs are not consistent  with  legislative  intent
13    and should be rejected.
14        NOW, THEREFORE, BE IT RESOLVED by the members of the First Regular Session
15    of  the  Fifty-fifth  Idaho  Legislature, the House of Representatives and the
16    Senate concurring therein, that IDAPA 13.01.08,  Section  421,  Subsection  01
17    only,  rules  of the Idaho Fish and Game Commission relating to mandatory deer
18    and elk report requirements, adopted as a pending  rule  under  Docket  Number
19    13-0108-9802,  and  IDAPA 13.01.15, Idaho Fish and Game Commission relating to
20    the use of dogs, adopted as a pending rule under Docket  Number  13-0115-9801,
21    be,  and  the  same is hereby rejected and declared null, void and of no force
22    and effect.

Statement of Purpose / Fiscal Impact


                       STATEMENT OF PURPOSE
                             RS 08927

This concurrent resolution would reject certain pending rules of the
Idaho Fish and Game Commission relating to mandatory deer and elk
report requirements and the use of hunting dogs. The effect of this
resolution, if adopted by both houses, would be to prevent the agency
rules from going into effect.

                            FISCAL NOTE

This resolution has no fiscal impact.
