                             IN THE HOUSE OF REPRESENTATIVES

                            HOUSE CONCURRENT RESOLUTION NO. 27

                            BY REVENUE AND TAXATION COMMITTEE

 1                               A CONCURRENT RESOLUTION
 2    STATING LEGISLATIVE  FINDINGS  AND  AUTHORIZING  THE  LEGISLATIVE  COUNCIL  TO
 3        APPOINT  A  COMMITTEE TO UNDERTAKE AND COMPLETE A STUDY OF IDAHO'S COUNTY,
 4        HIGHWAY DISTRICT AND STATE AGENCY HIGHWAYS WITH RESPECT  TO  JURISDICTION,
 5        MAINTENANCE, EASEMENTS, LIABILITY, TRAFFIC SIGNING AND CLOSURE.

 6    Be It Resolved by the Legislature of the State of Idaho:

 7        WHEREAS,  there  are thousands of miles of public highways in the state of
 8    Idaho being maintained by counties and highway districts; and
 9        WHEREAS, there are statutory requirements for counties  and  highway  dis-
10    tricts to prepare a map of their respective highway systems; and
11        WHEREAS,  inventory  of  the  federal  highway system of local highways is
12    required by the Federal Highway Administrator for inclusion in the  nationwide
13    system of highway performance; and
14        WHEREAS, the Local Land Use Planning Act requires the cities and counties,
15    in coordination with the highway districts to prepare a transportation element
16    of all required comprehensive plans; and
17        WHEREAS,  there  are  statutory requirements for the director of the Idaho
18    Transportation Department to certify the miles  of  improved  highways  within
19    each county and highway district highway system; and
20        WHEREAS, the Idaho Transportation Department has a program for the inspec-
21    tion and mapping of county and highway district highways; and
22        WHEREAS,  the Idaho Transportation Board has adopted a rule which provides
23    that a highway that is gated will not be classified as an "improved  highway";
24    and
25        WHEREAS,  a portion of the county and highway district funds for the High-
26    way Distribution Account is determined by the  number  of  miles  of  improved
27    highways in their respective jurisdictions; and
28        WHEREAS,  there  are  many  miles of improved highways being maintained by
29    counties and highway districts that pass through  lands  owned  by  the  Idaho
30    Department of Lands; and
31        WHEREAS,  the  Idaho  Department  of  Lands  has  gated  many miles of the
32    improved highways being maintained by counties and highway districts; and
33        WHEREAS, statutory provisions provide that roadways maintained by a county
34    or highway district are highways and shall be under the  jurisdiction  of  the
35    respective county or highway district; and
36        WHEREAS,  the  Department  of  Lands  is currently requesting counties and
37    highway districts to purchase and survey such easements that  have  tradition-
38    ally been maintained by a county or highway district.
39        NOW, THEREFORE, BE IT RESOLVED by the members of the First Regular Session
40    of  the  Fifty-fifth  Idaho  Legislature, the House of Representatives and the
41    Senate concurring therein, that the  Legislative  Council  is  authorized  and
42    directed  to appoint an interim committee to undertake and complete a study of
43    the policies and  procedures  regarding  jurisdiction,  easements,  liability,
44    maintenance,  traffic signing of improved highways crossing lands owned by the

 1    Idaho Department of Lands. The Legislative Council shall determine the  number
 2    of  legislators  and membership from each house appointed to the committee and
 3    shall authorize the committee to receive input,  advice  and  assistance  from
 4    interested and affected parties who are not members of the Legislature.
 5        BE IT FURTHER RESOLVED that nonlegislative members of the committee may be
 6    appointed  by  the cochairs of the committee who are appointed by the Legisla-
 7    tive Council. Nonlegislative members of the advisory committee  shall  not  be
 8    reimbursed  from legislative funds for per diem, mileage or other expenses and
 9    shall not have voting privileges regarding the committee's recommendations  or
10    proposed legislation.
11        BE  IT FURTHER RESOLVED that the committee shall report its findings, rec-
12    ommendations and proposed legislation, if any, to the Second  Regular  Session
13    of the Fifty-fifth Idaho Legislature.

                       STATEMENT OF PURPOSE
                              RS09192

This Concurrent Resolution authorizes the Legislative Council to
appoint a committee to undertake and complete a study of county,
highway district and state agency highways with respect to
jurisdiction, maintenance, easements, liability, traffic signing and
closure.





                            FISCAL NOTE

If this resolution is adopted by the Legislature and the committee is
appointed by Legislative Council, any necessary legislator travel and
per diem expense would be paid from the existing legislative
appropriation to the Senate and the House of Representatives. Funding
for staff support and expenses would be provided from the existing
appropriation to the Legislative Council for the Legislative Services
Office. There would be no additional impact upon the state general
fund as a result of this resolution.
