                            HOUSE CONCURRENT RESOLUTION NO. 29

                               BY WAYS AND MEANS COMMITTEE

 1                               A CONCURRENT RESOLUTION
 2    REQUESTING THE DIVISION OF ENVIRONMENTAL QUALITY TO MAKE THE NECESSARY CHANGES
 3        IN ITS ADMINISTRATIVE RULES IN ORDER TO REGULATE SWINE AND POULTRY FEEDING
 4        OPERATIONS.

 5    Be It Resolved by the Legislature of the State of Idaho:

 6        WHEREAS, the state of Idaho is experiencing the development of large swine
 7    and poultry feeding  operations  which  are  inadequately  controlled  through
 8    existing state regulatory mechanisms; and
 9        WHEREAS,  if  not  properly  regulated,  these facilities pose a threat to
10    Idaho's surface and ground water resources; and
11        WHEREAS, the Division of Environmental Quality, with minor  rule  changes,
12    and  working  in  conjunction  with the Idaho Department of Agriculture, could
13    provide additional regulatory control for these animal feeding operations.
14        NOW, THEREFORE, BE IT RESOLVED by the members of the First Regular Session
15    of the Fifty-fifth Idaho Legislature, the House  of  Representatives  and  the
16    Senate  concurring  therein,  that  the  Division  of Environmental Quality is
17    requested and authorized to consult with the Idaho Department  of  Agriculture
18    to  modify  the  present  administrative  rules of the division to ensure that
19    large swine and poultry feeding operations are adequately regulated.

Statement of Purpose / Fiscal Impact

                       STATEMENT OF PURPOSE

Idaho is being presented with a great opportunity. Large swine
and poultry feeding operations want to locate in the state.
Properly designed and operated, these businesses promise to
provide new job opportunities and enhance public and private
revenues. At the same time, they present unique challenges to the
state because of their very large size. Idaho does not have
adequate regulatory mechanisms in place to properly regulate
these operations while protecting the state's surface and ground
water resources.

This resolution solves the problem by authorizing and requesting
the Division of Environmental Quality, working in conjunction
with the Department of Agriculture, to modify the division's
administrative rules to provide for adequate regulation of large
swine and poultry feeding operations.




                            FISCAL NOTE

This legislation does not require a specific expenditure from the
General Fund. Costs normally associated with rule making by a
state agency will be incurred.
