                                   SENATE BILL NO. 1131

                                  BY EDUCATION COMMITTEE

 1                                        AN ACT
 2    RELATING TO POWERS OF THE STATE BOARD OF EDUCATION; AMENDING  SECTION  33-118,
 3        IDAHO  CODE,  TO  PROVIDE  THAT THE STATE BOARD SHALL REQUIRE TEXTBOOKS IN
 4        ELECTRONIC FORMAT FROM WHICH REPRODUCTIONS CAN BE PRODUCED.

 5    Be It Enacted by the Legislature of the State of Idaho:

 6        SECTION 1.  That Section 33-118, Idaho Code, be, and the  same  is  hereby
 7    amended to read as follows:

 8        33-118.  COURSES  OF  STUDY -- CURRICULAR MATERIALS. The state board shall
 9    prescribe the minimum courses to be taught in all public elementary  and  sec-
10    ondary schools, and shall cause to be prepared and issued, such syllabi, study
11    guides  and other instructional aids as the board shall from time to time deem
12    necessary. The board shall also determine how and under what rules  curricular
13    materials  shall  be  adopted  for  the  public schools.  The board shall
14    require all publishers of textbooks approved for use to furnish the department
15    of education with electronic format for literary and nonliterary subjects when
16    electronic formats become available for nonliterary subjects,  in  a  standard
17    format  approved by the board, from which reproductions can be made for use by
18    the blind.

The purpose of this legislation is to amend section 33-118, Idaho Code, to
provide that the State Board shall require textbooks on diskette from
which reproductions can be made for use by the blind.






                           FISCAL IMPACT

There will be no signiflcant fiscal impact as publishers can produce this
material at little or no cost. Many already have their textbooks on diskettes
because of requirements in other states.
