 1                                        AN ACT
 2    RELATING TO FUNDING FOR THE IDAHO HERITAGE  TRUST;  AMENDING  SECTION  49-450,
 3        IDAHO  CODE,  TO  DELETE  AN OBSOLETE REFERENCE AND TO PROVIDE THAT ON AND
 4        AFTER JANUARY 1, 2007, NONE OF THE FIFTY CENTS PER PLATE FEE SHALL BE DES-
 5        IGNATED TO THE IDAHO HERITAGE TRUST OR PAID FROM THE  PLATE  MANUFACTURING
 6        ACCOUNT  AND  TO  MAKE  A  TECHNICAL CORRECTION; AMENDING SECTION 49-450A,
 7        IDAHO CODE, TO DELETE AN OBSOLETE REFERENCE AND TO  PROVIDE  THAT  ON  AND
 8        AFTER JANUARY 1, 2007, NONE OF THE COSTS RELATED TO THE USE OF THE CENTEN-
 9        NIAL DESIGN ON THE LICENSE PLATE SHALL BE DESIGNATED TO THE IDAHO HERITAGE
10        TRUST;  AND  AMENDING  SECTION 67-7602B, IDAHO CODE, TO DELETE AN OBSOLETE
11        REFERENCE AND TO PROVIDE THAT NO FUNDS FROM THE PLATE FEE  SHALL  BE  DIS-
12        TRIBUTED  BY  THE  IDAHO  TRANSPORTATION  DEPARTMENT TO THE IDAHO HERITAGE
13        TRUST AND TO MAKE A TECHNICAL CORRECTION.

14    Be It Enacted by the Legislature of the State of Idaho:

15        SECTION 1.  That Section 49-450, Idaho Code, be, and the  same  is  hereby
16    amended to read as follows:

17        49-450.  ADDITIONAL  FEE FOR EACH PLATE ISSUED. In addition to the vehicle
18    registration fee provided by law, whenever any plate  is  issued  for  vehicle
19    registration, there shall be charged a fee of three dollars ($3.00) per plate,
20    which  shall be deposited into the plate manufacturing account created in sec-
21    tion 49-450A, Idaho Code. The  actual  cost  of  producing  and  manufacturing
22    license  plates   and  the  fifty  cents ( $. 50 [ ) per
23    plate fee designated to the Idaho heritage trust for  the  use  of  the  copy-
24    righted  design    provided  for in section 49-443(1), Idaho Code, 
25    shall be paid from the plate manufacturing account. The remainder of the plate
26    fee shall be deposited in the highway distribution account as  established  in
27    section  40-701,  Idaho Code, for apportionment as designated in that section.
28    Funds designated to the Idaho heritage trust shall be matched with equal funds
29    from other sources for funding projects designed to preserve Idaho's  historic
30    resources.    Provided however, on and after January 1, 2007, none of the
31    fifty cents (50[) per plate fee shall be  designated  to  the  Idaho  heritage
32    trust or paid from the plate manufacturing account. 

33        SECTION  2.  That  Section 49-450A, Idaho Code, be, and the same is hereby
34    amended to read as follows:

35        49-450A.  PLATE MANUFACTURING ACCOUNT. There  is  hereby  created  in  the
36    state treasury an account to be known as the "plate manufacturing account" for
37    the purpose of paying the actual cost to manufacture license plates and to pay
38    costs related to use of the centennial design on the license plate. All moneys
39    in  this  account  are hereby continuously appropriated to the department. Any
40    additional funds required to pay plate manufacturing costs will be transferred
41    by the state controller from the state highway account.    Provided  how-

 1    ever,  on  and  after January 1, 2007, none of the costs related to use of the
 2    centennial design on the license plate shall be paid  to  the  Idaho  heritage
 3    trust. 

 4        SECTION  3.  That Section 67-7602B, Idaho Code, be, and the same is hereby
 5    amended to read as follows:

 6        67-7602B.  FUNDING. The Idaho heritage trust shall receive funds collected
 7    in section 49-450, Idaho Code, in the amount of fifty cents  (50[)  per  plate
 8    for  the use of the copyrighted design .   provided in section
 9    49-443(10), Idaho Code.  The Idaho transportation department shall  col-
10    lect  such  funds  and  distribute them to the Idaho heritage trust fund quar-
11    terly.  Provided however, on and after January 1, 2007, no funds from the
12    plate fee shall be distributed by the department to the Idaho heritage  trust.
13       The role of the heritage trust is to accept proposals from the public
14    requesting funds for heritage preservation projects. The proposals are  evalu-
15    ated on established criteria, and if in the opinion of the heritage trust they
16    qualify, a grant may be awarded subject to the availability of funds. The her-
17    itage  trust  shall insure that the following occurs in respect to the manage-
18    ment of funds:
19        (1)   Through December 31, 2006, f   F  unds  earned
20    from  the  use  of  the  motor vehicle license plate design shall be deposited
21    directly into the trust fund where it will earn interest that will be used for
22    heritage preservation projects. Contributions from private  fund  raising
23        fundraising    efforts may also be deposited to the trust
24    fund.
25        (2)  Only the interest earned from the trust fund shall be  expended,  and
26    the trust fund shall remain as a permanent endowment generating income in per-
27    petuity for heritage preservation.
28        (3)  The  Idaho heritage trust shall require project sponsors to match the
29    funds granted for each project, so that no more than half the monetary support
30    for any project shall come from the proceeds of the trust fund.

Statement of Purpose / Fiscal Impact


                       STATEMENT OF PURPOSE

                             RS08957

This bill sunsets $.50 fee paid to Idaho Heritage Trust on and
after January 1, 2007. The year 2007 is the next reissue date for
the plates. This will require new design to avoid copyright design
for which state has been paying $.50 per plate fee.








                           FISCAL NOTE

Under the staggered reissue license plate program, from 2007 to
2019, based on the sale of approximately 3,000,000 plates,
$1,500,000 would no longer be collected for the Idaho Heritage
Trust. Plate fee revenue collected over and above the cost of
manufacturing license plates would go to the Highway Distribution
Account
