  1                                        AN ACT
  2    RELATING TO THE STATE BOARD OF PODIATRY; AMENDING SECTION 54-604, IDAHO  CODE,
  3        TO  PROVIDE  THAT  RECOMMENDATIONS TO THE GOVERNOR FOR APPOINTMENTS TO THE
  4        BOARD OF PODIATRY SHALL BE FROM THE IDAHO PODIATRIC  MEDICAL  ASSOCIATION;
  5        AND PROVIDING AN EFFECTIVE DATE.
                                                                        
  6    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
  7        SECTION  1.  That  Section  54-604, Idaho Code, be, and the same is hereby
  8    amended to read as follows:
                                                                        
  9        54-604.  ESTABLISHMENT OF STATE BOARD OF PODIATRY. There is hereby  estab-
 10    lished  in the department of self-governing agencies a state board of podiatry
 11    to be composed of five (5) members to be appointed by the governor in the man-
 12    ner hereinafter set forth. Four (4) of said members shall be podiatrists, duly
 13    licensed under the laws of the state of Idaho, and who shall have been contin-
 14    uously engaged in the practice of podiatry for a period of not less than  five
 15    (5)  years  prior to his appointment. The fifth member of the board shall be a
 16    layman, a resident of the state of Idaho for a period of not  less  than  five
 17    (5)  years  prior  to  his appointment. With reference to the first board, the
 18    four (4) podiatrists shall be appointed for terms of one (1), two  (2),  three
 19    (3)  and four (4) years, respectively. The lay board member shall be appointed
 20    for a term of three (3) years. Thereafter, all appointments to the board shall
 21    be made for terms of four (4) years. Vacancies upon the board,  occurring  for
 22    any  reason,  shall be filled by the governor. The governor in making appoint-
 23    ments shall give consideration to but shall not be bound  by  the  recommenda-
 24    tions received from the Idaho Podiatry Podiatric Medical Association.
 25        Within thirty (30) days from the appointment of the board by the governor,
 26    the board shall organize itself, select a chairman, a vice chairman and secre-
 27    tary.  The  chairman  and  the secretary shall be podiatrists. The board shall
 28    meet annually for the purpose of conducting examinations and  transacting  any
 29    other  business  which may lawfully come before it. The board may meet in spe-
 30    cial session at the call of the chairman, or at the call of not less than two-
 31    thirds (2/3) of the membership of the board. The members of  the  board  shall
 32    each be compensated as provided by section 59-509(g), Idaho Code.
 33        Examinations of applicants may be conducted by the board, or by designated
 34    representatives of the board.
 35        A  quorum  will  consist  of at least three (3) members of the  board. The
 36    chairman, or person acting as such, will vote only in the case of a tie.
                                                                        
 37        SECTION 2.  This act shall be in full force and effect on and  after  July
 38    1, 2000.

Medical Association.
