  1                                        AN ACT
  2    RELATING TO BAIL IN CRIMINAL CASES; AMENDING SECTION 19-2923, IDAHO  CODE,  TO
  3        PROVIDE THAT CASH BAIL POSTED IN A CASE MAY BE USED TO SATISFY FINES, FEES
  4        AND  COSTS  THAT HAVE BEEN IMPOSED IN THAT CASE OR WHICH HAVE BEEN IMPOSED
  5        AGAINST THE DEFENDANT IN ANY OTHER CRIMINAL ACTION.
                                                                        
  6    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
  7        SECTION 1.  That Section 19-2923, Idaho Code, be, and the same  is  hereby
  8    amended to read as follows:
                                                                        
  9        19-2923.  DEPOSIT  APPLIED  TO  PAYMENT OF FINES, FEES AND COSTS. When the
 10    money has been deposited, if  it  remains  on  deposit  at  the  time  of  the
 11    judgment,  for  the  payment of a fine, the clerk must, under the direction of
 12    the court, apply the money in satisfaction thereof, of fines, fees  and  costs
 13    imposed  in the case and fines, fees and costs which have been imposed against
 14    the defendant in any other criminal action, and after  satisfying  the  fines,
 15    fees  and  costs,  must  refund  the surplus, if any, to the party posting the
 16    deposit.

                 STATEMENT OF PURPOSE

     This bill amends section 19-2923, Idaho Code, to permit the use of cash bail to
     satisfy fines, fees, and costs levied in any criminal action.
      
     Section 19-2923, Idaho Code, presently requires cash bail posted in a case to be
     applied against the fine levied in that case by the defendant, but is ambiguous
     concerning other fees and costs that may also be levied in that 
     action, and is silent regarding delinquent fines, fees, and costs that have been
     imposed against the defendant in a separate criminal case. This bill will clarify
     these issues and will be helpful to the prompt collection of these amounts. 
     
     
     
                     FISCAL NOTE 
     
     This bill will improve fine and court costs collections which will lead to
     additional revenue to various state and local funds, the amount of which cannot
     accurately be estimated at this time.
