S1375|||| LEGISLATURE OF THE STATE OF IDAHO |||| Fifty-fifth Legislature Second Regular Session - 2000IN THE SENATE SENATE BILL NO. 1375 BY STATE AFFAIRS COMMITTEE 1 AN ACT 2 RELATING TO VENDOR ASSISTED SALES OF TOBACCO PRODUCTS; AMENDING SECTION 3 39-5706, IDAHO CODE, TO ALLOW A TOBACCO PRODUCT RETAILER OR AN EMPLOYEE 4 OF THE RETAILER TO HAVE ACCESS TO TOBACCO PRODUCTS OF A RETAILER; AND 5 DECLARING AN EMERGENCY. 6 Be It Enacted by the Legislature of the State of Idaho: 7 SECTION 1. That Section 39-5706, Idaho Code, be, and the same is hereby 8 amended to read as follows: 9 39-5706. VENDOR ASSISTED SALES. (1) It shall be unlawful to sell or dis- 10 tribute tobacco products by any means other than vendor assisted sales where 11 the customer has no access to the product except through the assistance of the 12 seller, except where the customer is a tobacco product retailer or an employee 13 of the tobacco product retailer and the customer can evidence such status by 14 showing the permit issued pursuant to section 39-5704, Idaho Code, and if an 15 employee of the tobacco product retailer presents a signed letter from the 16 retailer evidencing the employer-employee relationship and the authorization 17 for the employee to purchase tobacco products for the tobacco retailer's busi- 18 ness. 19 (2) On and after January 1, 2000, it shall be unlawful to sell or dis- 20 tribute tobacco products from a vending machine. From January 1, 1999, to 21 December 31, 1999, vending machines shall be located in a place not accessible 22 to persons under the age of nineteen (19) years. 23 (3) It shall be unlawful to sell or distribute tobacco products from 24 self-service displays. 25 (4) Stores with tobacco products comprising at least seventy-five percent 26 (75%) of total merchandise are exempt from requiring vendor assisted sales, if 27 minors are not allowed in the store and such prohibition is posted clearly on 28 all entrance doors. 29 SECTION 2. An emergency existing therefor, which emergency is hereby 30 declared to exist, this act shall be in full force and effect on and after its 31 passage and approval.
STATEMENT OF PURPOSE RS09522 This measure would amend Idaho Code to allow a tobacco product retailer or employee of a licensed retailer to have access to tobacco products in an outside retail establishment.
