S1437|||| LEGISLATURE OF THE STATE OF IDAHO |||| Fifty-fifth Legislature Second Regular Session - 2000IN THE SENATE SENATE BILL NO. 1437 BY AGRICULTURAL AFFAIRS COMMITTEE 1 AN ACT 2 RELATING TO DAIRY FARMS; AMENDING SECTION 37-401, IDAHO CODE, TO REQUIRE DAIRY 3 FARMS TO HAVE NUTRIENT MANAGEMENT PLANS APPROVED BY THE DEPARTMENT OF 4 AGRICULTURE; AND DECLARING AN EMERGENCY. 5 Be It Enacted by the Legislature of the State of Idaho: 6 SECTION 1. That Section 37-401, Idaho Code, be, and the same is hereby 7 amended to read as follows: 8 37-401. INSPECTIONS, EXAMINATIONS AND TESTS BY DEPARTMENT OF AGRICULTURE 9 -- DAIRY FARMS -- NUTRIENT MANAGEMENT PLANS REQUIRED. The director of the 10 department of agriculture is hereby authorized and directed to designate any 11 agent to inspect, examine and test any or all dairy products in accordance 12 with rules as the department may prescribe; and to ascertain and certify the 13 grade, classification, quality or sanitary condition thereof and other perti- 14 nent facts as the department may require. The director or agent of the depart- 15 ment of agriculture of the state of Idaho shall make sanitary inspection of 16 milk, cream, butter and dairy products of any kind whatsoever, intended for 17 human consumption, and of containers, utensils, equipment, buildings, premises 18 or anything whatsoever employed in the production, handling, storing, process- 19 ing or manufacturing of dairy products or that would affect the purity of the 20 products. Inspections, examinations and tests shall be made to meet the 21 requirements of the laws of the state and of the United States for the sale of 22 the products or their transportation in both intrastate and interstate com- 23 merce. Any agent designated by the director to make inspections shall have the 24 right for that purpose to enter any premises and buildings where milk, cream, 25 butter or dairy products shall be produced, stored, processed or manufactured. 26 Acting in accord with rules of the department, the director or agent of the 27 department shall review plans and specifications for construction of new, mod- 28 ified or expanded waste systems and inspect any dairy farm to ascertain and 29 certify sanitary conditions, waste systems and milk quality. The director or 30 agent shall issue a permit authorizing the sale of milk for human consumption 31 to all dairy farms that meet the requirements of this chapter, and rules pro- 32 mulgated pursuant to this chapter. All dairy farms shall have a nutrient man- 33 agement plan approved by the department. Existing dairy farms shall submit a 34 nutrient management plan to the department on or before July 1, 2001. Any new 35 dairy farms or dairy farms that change owners or operators shall have an 36 approved nutrient management plan on file with the department prior to the 37 issuance of the milk permit for that dairy. The nutrient management plan shall 38 be implemented upon approval of the plan by the department. 39 SECTION 2. An emergency existing therefor, which emergency is hereby 40 declared to exist, this act shall be in full force and effect on and after its 41 passage and approval.
REPRINT REPRINT REPRINT REPRINT REPRINT REPRINT STATEMENT OF PURPOSE RS 09994 The purpose of this proposed legislation is to amend Chapter 4, Title 37, Idaho Code, to require all dairy farms in the state to develop nutrient management plans and submit the plans to the Department of Agriculture for approval, to provide a deadline by which existing dairy farms shall submit nutrient management plans to the Department, to require all new dairy farms or dairy farms that change owners or operators to have a nutrient management plan before issuance of a milk permit, and to require dairy farms to implement nutrient management plans upon approval of the plans by the department.
