S1513|||| LEGISLATURE OF THE STATE OF IDAHO |||| Fifty-fifth Legislature Second Regular Session - 2000IN THE SENATE SENATE BILL NO. 1513 BY RESOURCES AND ENVIRONMENT COMMITTEE 1 AN ACT 2 RELATING TO FISH AND GAME; AMENDING SECTION 36-601, IDAHO CODE, TO REQUIRE 3 CERTAIN PERSONS TO OBTAIN A COMMERCIAL WILDLIFE LICENSE AND TO MAKE TECH- 4 NICAL CORRECTIONS; AMENDING SECTION 36-602, IDAHO CODE, TO PROVIDE FOR 5 RESIDENT AND NONRESIDENT COMMERCIAL WILDLIFE LICENSES, TO PROVIDE FEES AND 6 TO MAKE TECHNICAL CORRECTIONS; AND AMENDING SECTION 36-603, IDAHO CODE, TO 7 REQUIRE RECORDKEEPING. 8 Be It Enacted by the Legislature of the State of Idaho: 9 SECTION 1. That Section 36-601, Idaho Code, be, and the same is hereby 10 amended to read as follows: 11 36-601.TAXIDERMIST AND FUR BUYERS MUST PROCURE LICENSECOMMERCIAL WILD- 12 LIFE LICENSE REQUIRED. (a1)Taxidermy -- License Required.Any person who at 13 any time within the state of Idaho desires to mount, preserve or prepare for 14 preservation any of the dead bodies of any wildlife or any part thereof not 15 personally taken by him in compliance with the provisions of this title,must16obtain a taxidermist license. Without paying an additional fee for a fur17buyer's license, the holder of a taxidermist's license shall be entitled to18engage in purchases as provided in subsection (b) of this section.19(b) Purchase of Hides, Skins or Pelts -- License Required. Any personor 20 who engages in the business of buying raw black bear skins, raw cougar skins 21 or parts of black bears or cougars, or the raw hides, skins, or pelts of any 22 of the fur bearers of this state must obtain afur buyer'scommercial wildlife 23 license. 24 (c2)Said taxidermist and fur buyer licensesThe commercial wildlife 25 license shall be obtained from the director for a fee and subject to the limi- 26 tationshereinafter providedof this chapter. 27 SECTION 2. That Section 36-602, Idaho Code, be, and the same is hereby 28 amended to read as follows: 29 36-602. LICENSE FEES -- EXPIRATION. (a1) ResidentTaxidermistCommercial 30 Wildlife License. A fee oftenthirty-five dollars ($1035.00) shall be charged 31 for a residenttaxidermistcommercial wildlife license. 32 (b2) NonresidentTaxidermistCommercial Wildlife License. Nonresidents 33 shall pay an amount equal to that charged Idaho residents in the state of the 34 applicant fora nonresident fur buyer'sthe license. In cases where the state 35 of the applicant requires more than one (1) license, the cost shall be the 36 total for all licenses required of an Idaho resident to engage in similar 37 activities. In no case shall this amount be less thanfortyone hundred 38 twenty-five dollars ($40.00125). The department shall promulgate rules imple- 39 menting the provisions of this section. 40(c) Resident Fur Buyers License. A fee of five dollars ($5.00) shall be41charged for a resident fur buyers license.2 1(d) Nonresident Fur Buyers License. Nonresidents shall pay an amount2equal to that charged Idaho residents in the state of the applicant for a non-3resident fur buyer's license. In no case shall this amount be less than twenty4dollars ($20.00). The department shall promulgate rules implementing the pro-5visions of this section.6 (e3) The expiration date forsuchcommercial wildlife licenses shall be 7 June 30 next following the date of issuance. 8 SECTION 3. That Section 36-603, Idaho Code, be, and the same is hereby 9 amended to read as follows: 10 36-603.TAXIDERMISTS' AND FUR BUYERS'RECORDS. Any person licensed under 11 the provisions of this chapter shall keep a record for two (2) years last past 12 of wildlifeor the hides, skins, or pelts thereofreceived forpreserving or13salemounting or preserving and fur bearers purchased. Records may be written 14 or may be retained on media other than paper, provided that the form or medium 15 complies with the standards set forth in section 9-328, Idaho Code.SuchThe 16 record shall be made upon a form provided by the department which sets forth 17 such information as may be required by the director and shall be subject to 18 his inspection at any time.
STATEMENT OF PURPOSE RS 10061 The purpose of this legislation is to amend Section 36-601, Idaho Code, to combine fur buyers licenses and taxidermists licenses into one license, to be known as a commercial wildlife license. FISCAL IMPACT This legislation will raise approximately the same amount of money as the proposed new fee structure. Contact: Senator Gary 1.
