  1                                        AN ACT
  2    RELATING TO THE LEGISLATURE; AMENDING CHAPTER 4, TITLE 67, IDAHO CODE, BY  THE
  3        ADDITION  OF  A NEW SECTION 67-404f, IDAHO CODE, TO PROVIDE FOR SUCCESSION
  4        TO THE OFFICE OF PRESIDENT PRO TEMPORE OF THE SENATE.
                                                                        
  5    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
  6        SECTION 1.  That Chapter 4, Title 67, Idaho Code,  be,  and  the  same  is
  7    hereby  amended by the addition thereto of a NEW SECTION, to be known and des-
  8    ignated as Section 67-404f, Idaho Code, and to read as follows:
                                                                        
  9        67-404f.  SUCCESSION TO OFFICE OF PRESIDENT PRO TEMPORE OF THE SENATE.  In
 10    case of the death, permanent incapacity, resignation or removal from office of
 11    the  president  pro tempore of the senate, the leader of the majority party in
 12    the senate shall succeed to all of the powers and duties, both  statutory  and
 13    constitutional,  of  the  president pro tempore of the senate until the senate
 14    meets and elects, pursuant to the rules of the senate,  a  new  president  pro
 15    tempore.

                 STATEMENT OF PURPOSE

     This bill would provide for the temporary succession to the office of President Pro
     Tempore of the Senate in the instance of death, permanent incapacity, resignation
     or removal from office, until the Senate can meet and elect a new President Pro
     Tempore.
