  1                                        AN ACT
  2    RELATING TO THE DEPARTMENT OF  AGRICULTURE;  AMENDING  SECTION  22-101,  IDAHO
  3        CODE,  TO PROVIDE THAT FOR THE PURPOSES OF INTERNATIONAL TRADE, THE DIREC-
  4        TOR OF THE DEPARTMENT OF AGRICULTURE MAY USE THE TITLE OF SECRETARY OF THE
  5        DEPARTMENT AND TO MAKE TECHNICAL CORRECTIONS; AND PROVIDING  AN  EFFECTIVE
  6        DATE.
                                                                        
  7    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
  8        SECTION  1.  That  Section  22-101, Idaho Code, be, and the same is hereby
  9    amended to read as follows:
                                                                        
 10        22-101.  DEPARTMENT CREATED -- APPOINTMENT OF DIRECTOR -- RULES. AND REGU-
 11    LATIONS. (1) There is hereby created the department of agriculture. The gover-
 12    nor shall appoint a director of the department of agriculture, subject to  the
 13    provisions  of  section 67-2404, Idaho Code. The director of the department of
 14    agriculture shall exercise all of the powers and duties necessary to carry out
 15    the proper administration of the department of agriculture. The department  of
 16    agriculture  shall, for the purposes of section 20, article IV, of the consti-
 17    tution of the state of Idaho, be an executive department of the state  govern-
 18    ment.
 19        (2)  The  director  shall be a person who is qualified by training, knowl-
 20    edge and demonstrated ability or experience in agricultural pursuits and their
 21    management.
 22        (3)  The director is empowered to prescribe rules and regulations pursuant
 23    to law for the governance of the department.
 24        (4)  For the purposes of international trade, the  director  may  use  the
 25    title of secretary of the department.
                                                                        
 26        SECTION  2.  This  act shall be in full force and effect on and after July
 27    1, 2000.

Statement of Purpose / Fiscal Impact


                      STATEMENT OF PURPOSE
                            RS09377
Amend Title 22, Chapter 1, Idaho Code, Section 22-101 to 
provide authority for the director to use the title of 
"secretary" for the purpose of conducting business in 
international matters.  The term "director" is not a 
common title in a number of foreign countries.  Giving the 
director authority to use the title "secretary", a common 
title, would promote a better understanding of his 
responsibilities and authority.
