  1                                        AN ACT
  2    RELATING TO COUNTY FAIR BOARDS; AMENDING SECTION 22-204, IDAHO CODE,  TO  PRO-
  3        VIDE  THAT  COUNTY  FAIR  BOARD MEMBERS MAY FILE ANOTHER FORM OF FINANCIAL
  4        RESPONSIBILITY SUITABLE TO THE BOARD OF COUNTY COMMISSIONERS IN LIEU OF  A
  5        SURETY  BOND  AND  TO PROVIDE THAT THE FAIR BOARD SHALL MEET IN SUCH TIMES
  6        AND PLACES AS THE COUNTY FAIR BOARD DEEMS NECESSARY IN COMPLIANCE WITH THE
  7        OPEN MEETING LAW; AND PROVIDING AN EFFECTIVE DATE.
                                                                        
  8    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
  9        SECTION 1.  That Section 22-204, Idaho Code, be, and the  same  is  hereby
 10    amended to read as follows:
                                                                        
 11        22-204.  DUTIES  OF  COUNTY  FAIR BOARD -- BONDS OF MEMBERS -- MEETINGS --
 12    FURTHER DUTIES. The county fair board shall be charged with the care and  cus-
 13    tody  of  all property belonging to the county and used for fair purposes, and
 14    shall be responsible for all moneys received by it,  raised  by  tax  levy  or
 15    levies  for  fair  purposes  as well as all receipts from the operation of the
 16    fair and any other moneys received from other sources for fair purposes.  Each
 17    member  of  the  county fair board shall file with the board of county commis-
 18    sioners a bond or other form  of  financial  responsibility  suitable  to  the
 19    county  commissioners   in  the  sum  of  not  less  than one thousand dollars
 20    ($1,000) to be approved by the board of county commissioners. The county  fair
 21    board  shall  conduct all of its business at the place designated by the board
 22    of county commissioners as the place for conducting  the  county  fair,  which
 23    shall  be the place of business of the county fair board. It shall meet at its
 24    place of business on the first Monday of January each year, and thereafter bi-
 25    monthly on the first Monday of the month, except as herein otherwise provided;
 26    provided, that it shall meet on the first Monday after the  creation  of  such
 27    board  under  the  provisions  hereof such times and places as the county fair
 28    board deems necessary in compliance with the open meeting law.
 29        It shall safely keep or cause to be safely kept all moneys coming into its
 30    care, custody or possession in strict compliance with the  provisions  of  the
 31    public depository law of this state. It shall formulate in writing and file in
 32    its  office  all  plans adopted by it from time to time in connection with the
 33    conduct of the business of the county fair, and also file a copy of  the  same
 34    with  the  board of county commissioners of the county. It shall keep or cause
 35    to be kept proper records of its proceedings, business transactions, and  true
 36    and  proper accounts of all moneys received by it and expended or on hand; and
 37    it shall require proper vouchers evidencing all disbursements  of  money.  The
 38    records  of  the  board  shall  be open to inspection by any taxpayer or voter
 39    within the county during all regular office hours. The board shall publish  in
 40    at  least  one  (1)  issue  of the official newspaper of the county a detailed
 41    statement of all moneys received and expended in connection with the operation
 42    of any fair or fairs, within ninety (90) days after the holding  of  any  such
 43    fair within the county.

  1        It  shall  take  charge  of and manage all such property as the county may
  2    have acquired or set aside for fair purposes pursuant  to  the  provisions  of
  3    section  31-822,  Idaho  Code. It may recommend to the board of county commis-
  4    sioners that such board purchase such real and personal  property  as  may  be
  5    needed  for fair purposes. It shall have power to  employ labor, award prizes,
  6    make exhibition contracts, fix and charge admission  and  entrance  fees,  let
  7    contracts for concessions or services to be conducted at the fair or under the
  8    direction  of  the  county  fair board, but if any concession or service is to
  9    extend for a period of less than twelve (12) days in a calendar year, the con-
 10    cession or service may be awarded without bid, and do all other things  neces-
 11    sary  for holding county fairs. It shall fix the salaries of the secretary and
 12    treasurer and prescribe the time and manner of payment. The county fair  board
 13    shall not have the power to create any indebtedness in excess of the amount to
 14    be derived from the special levies for each year and the estimated income from
 15    annual  fair  receipts,  nor shall it mortgage or otherwise pledge or encumber
 16    any of the real or personal property owned by the county  and  used  for  fair
 17    purposes.
                                                                        
 18        SECTION  2.  This  act shall be in full force and effect on and after July
 19    1, 2000.

Statement of Purpose / Fiscal Impact


                      STATEMENT OF PURPOSE
                            RS 09587 

The purpose of this legislation is to amend Idaho Code, Section 
22-204, The Duties of County Fair Boards, to include the following 
revisions:

First, to provide the County Fair Board members with the ability to 
file another form of financial assurance suitable to the County 
Commissioners in lieu of a bond.

Second, to provide that the Fair Board shall meet at such times and 
places as the County Fair Board deems necessary in compliance with 
the Open Meeting Law; and providing a flexibility in selecting a 
meeting date to Board Members, schedules.
