PRESIDENTIAL PREFERENCE PRIMARY - Adds to existing law to provide that a
presidential preference primary shall not be conducted for any political
party whose state chairman certifies to the Secretary of State, not later
than sixty days prior to the election, that the chairman's party is

  1                                        AN ACT
  2    RELATING TO THE PRESIDENTIAL PREFERENCE PRIMARY; AMENDING CHAPTER 7, TITLE 34,
  3        IDAHO CODE, BY THE ADDITION OF A NEW SECTION 34-731A, IDAHO CODE, TO  PRO-
  4        VIDE   A  PRESIDENTIAL  PREFERENCE  PRIMARY SHALL NOT BE CONDUCTED FOR ANY
  5        POLITICAL PARTY WHOSE STATE CHAIRMAN CERTIFIES TO THE SECRETARY OF  STATE,
  6        NOT LATER THAN SIXTY DAYS PRIOR TO THE ELECTION, THAT THE CHAIRMAN'S PARTY
  7        IS  SELECTING CANDIDATES AND DELEGATES BY ANOTHER METHOD AND TO PROVIDE NO
  8        APPLICATION TO POLITICAL PARTIES WHOSE PRIMARY BALLOT IS NOT PRINTED  PUR-
  9        SUANT TO STATUTE; AND DECLARING AN EMERGENCY.
                                                                        
 10    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
 11        SECTION  1.  That  Chapter  7,  Title  34, Idaho Code, be, and the same is
 12    hereby amended by the addition thereto of a NEW SECTION, to be known and  des-
 13    ignated as Section 34-731A, Idaho Code, and to read as follows:
                                                                        
 14        34-731A.  PRESIDENTIAL  PREFERENCE PRIMARY -- WHEN NOT CONDUCTED. A presi-
 15    dential preference primary shall not be  conducted  for  any  political  party
 16    whose state chairman certifies to the secretary of state, not later than sixty
 17    (60) days prior to the election, that the chairman's party is selecting candi-
 18    dates and delegates by another method.
 19        This  section  shall  only  apply to those political parties whose primary
 20    ballot is not printed pursuant to the  provisions  of  section  34-904,  Idaho
 21    Code.
                                                                        
 22        SECTION  2.  An  emergency  existing  therefor,  which emergency is hereby
 23    declared to exist, this act shall be in full force and effect on and after its
 24    passage and approval.

  1                                AMENDMENT TO SECTION 1
  2        On page 1 of the printed bill, following line 17, insert:
  3        "This section shall only apply to those political  parties  whose  primary
  4    ballot  is  not  printed  pursuant  to the provisions of section 34-904, Idaho
  5    Code.".
                                                                        
  6                                 CORRECTION TO TITLE
  7        On page 1, in line 7, following "METHOD" insert: "AND TO PROVIDE NO APPLI-
  8    CATION TO POLITICAL PARTIES WHOSE PRIMARY BALLOT IS NOT  PRINTED  PURSUANT  TO
  9    STATUTE".

Statement of Purpose / Fiscal Impact


                    STATEMENT OF PURPOSE
                             RS09707 

This legislation would allow a political party to opt out of the 
presidential preference primary if proper notice is given to the 
Secretary of State. Various parties' rules conflict with Idaho's 
presidential preference primary procedures and this legislation 
enables the party to follow their rules without the counties 
incurring ballot printing expenses.

                           FISCAL NOTE

No impact to the general fund, however counties should experience 
a decrease in ballot printing costs.
