  1                                        AN ACT
  2    RELATING TO REGISTRATION OF MOTOR VEHICLES;  AMENDING  SECTION  49-402,  IDAHO
  3        CODE,  TO  PROVIDE  AN ANNUAL REGISTRATION FEE FOR SCHOOL BUSES IF CERTAIN
  4        CONDITIONS ARE OCCURRING AND TO MAKE A TECHNICAL CORRECTION; DECLARING  AN
  5        EMERGENCY AND PROVIDING RETROACTIVE APPLICATION.
                                                                        
  6    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
  7        SECTION  1.  That  Section  49-402, Idaho Code, be, and the same is hereby
  8    amended to read as follows:
                                                                        
  9        49-402.  ANNUAL REGISTRATION. (1) The annual fee for operating each pickup
 10    truck and each other motor vehicle having a maximum gross weight not in excess
 11    of eight thousand (8,000) pounds shall be:
 12        Vehicles one (1) and two (2) years old ............................ $48.00
 13        Vehicles three (3) and four (4) years old ......................... $36.00
 14        Vehicles five (5) and six (6) years old ........................... $36.00
 15        Vehicles seven (7) and eight (8) years old ........................ $24.00
 16        Vehicles over eight (8) years old ................................. $24.00
 17        There shall be twelve (12) registration periods, starting in  January  for
 18    holders of validation registration stickers numbered 1, and proceeding consec-
 19    utively  through December for holders of validation registration stickers num-
 20    bered 12, each of which shall start on the first day of a calendar  month  and
 21    end  on  the last day of the twelfth month from the first day of the beginning
 22    month. Registration periods shall expire midnight on the last day of the  reg-
 23    istration  period  in  the  year  designated  by  the  validation registration
 24    sticker. The numeral digit on the validation registration stickers  shall,  as
 25    does  the  registration  card, fix the registration period under the staggered
 26    plate system of Idaho for the purpose of reregistration and notice of  expira-
 27    tion.
 28        A  vehicle  that  has once been registered for any of the above designated
 29    periods shall, upon reregistration, be registered for the period  bearing  the
 30    same  number,  and the registration card shall show and be the exclusive proof
 31    of the expiration date of registration and licensing.  Vehicles  may  be  ini-
 32    tially registered for less than a twelve (12) month period, or for more than a
 33    twelve (12) month period, and the fee prorated on a monthly basis if the frac-
 34    tional  registration tends to fulfill the purpose of the monthly series regis-
 35    tration system.
 36        (2)  For all school buses operated either by a nonprofit, nonpublic school
 37    or operated pursuant to a service contract with a school district  for  trans-
 38    porting  children  to  or  from  school  or in connection with school approved
 39    activities, the annual fee shall be twenty-four dollars ($24.00).
 40        (3)  For all motorcycles and  all-terrain vehicles the annual fee shall be
 41    nine dollars ($9.00). For operation of an ATV off the public highways, the fee
 42    specified in section 67-7122, Idaho Code, shall  also  be  paid.  Registration
 43    exemptions  provided  in  section  49-426(2), Idaho Code, apply to all-terrain

  1    vehicles and motorcycles used for the purposes described  in  that  subsection
  2    (2).
  3        (34)  For  all motor homes the fee shall be as specified in subsection (1)
  4    of this section and shall be in addition to the fees provided for  in  section
  5    49-445, Idaho Code.
  6        (45)  Registration fees shall not be subject to refund.
  7        (56)  A  financial  institution  or  repossession  service contracted to a
  8    financial institution repossessing vehicles under  the  terms  of  a  security
  9    agreement  shall move the vehicle from the place of repossession to the finan-
 10    cial institution's place of business on a repossession plate. The repossession
 11    plate shall also be used for demonstrating the vehicle to a  prospective  pur-
 12    chaser for a period not to exceed ninety-six (96) hours. The registration fees
 13    for repossession plates shall be as required in subsection (1) of this section
 14    for  a  vehicle  one  (1) and two (2) years old. All other fees required under
 15    chapter 4, title 49, Idaho Code, shall be in addition to the registration fee.
 16    The repossession plate shall be issued on an annual basis by the department.
 17        (67)  In addition to the annual registration fee in  this  section,  there
 18    shall  be an initial program fee of twenty-five dollars ($25.00) and an annual
 19    program fee of fifteen dollars ($15.00) for all special license plate programs
 20    for those license plates issued pursuant to sections 49-404A, 49-407,  49-408,
 21    49-409,  49-414, 49-416 and 49-418, Idaho Code. For special plates issued pur-
 22    suant to sections 49-406 and 49-406A, Idaho Code, there shall  be  an  initial
 23    program  fee  of  twenty-five  dollars  ($25.00)  but there shall be no annual
 24    renewal fee. For special plates issued pursuant to sections  49-417,  49-417A,
 25    49-417B,  49-418A,  49-419,  49-419A and 49-420, Idaho Code, there shall be an
 26    initial program fee of thirty-five dollars ($35.00) and an annual program  fee
 27    of twenty-five dollars ($25.00). For special plates issued pursuant to section
 28    49-418A,  Idaho Code, the initial program fee and the annual renewal fee shall
 29    be fifty dollars ($50.00). The fees contained  in  this  subsection  shall  be
 30    applicable  to all new special plate programs. The initial program fee and the
 31    annual program fee shall be deposited as specified by law for each program.
                                                                        
 32        SECTION 2.  An emergency existing  therefor,  which  emergency  is  hereby
 33    declared to exist, this act shall be in full force and effect on and after its
 34    passage and approval, and retroactively to January 1, 2000.

STATEMENT OF PURPOSE

RS 09826

This RS amends Section 49-402 Idaho Code.

Senate Bill 1163, passed in 1999, made contract buses operated by

a nonprofit or nonpublic school or operated pursuant to a service

contract with a school district subject to 49-434, which provides

a schedule of fees based on weight.

This amendment places buses used in transporting children to or

from school or in connection with school approved activities back

to the fee used prior to Senate Bill 1163.

FISCAL IMPACT

There could be some savings in the general fund appropriation to

public schools.
