  1                                        AN ACT
  2    RELATING TO CHARTER SCHOOLS; AMENDING SECTION 33-5210, IDAHO CODE, TO  REQUIRE
  3        THAT CHARTER SCHOOLS COMPLY WITH THE REQUIREMENT THAT ALL SCHOOL EMPLOYEES
  4        UNDERGO A CRIMINAL HISTORY CHECK; AND PROVIDING AN EFFECTIVE DATE.
                                                                        
  5    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
  6        SECTION  1.  That  Section 33-5210, Idaho Code, be, and the same is hereby
  7    amended to read as follows:
                                                                        
  8        33-5210.  APPLICATION OF SCHOOL LAW -- ACCOUNTABILITY  --  EXEMPTION  FROM
  9    STATE  RULES. (1) All public charter schools are under the general supervision
 10    of the state board of education.
 11        (2)  The local board of trustees and the  state  board  of  education  are
 12    responsible  to  ensure  that each charter school program approved by it meets
 13    the terms of the charter, and operates in accordance  with  the  state  educa-
 14    tional standards of thoroughness as defined in section 33-1612, Idaho Code.
 15        (3)  Each  charter  school is otherwise exempt from rules governing school
 16    districts which have been promulgated by the state board of  education  or  by
 17    the  superintendent  of  public instruction, with the exception of state rules
 18    relating to:
 19        (a)  Waiver of teacher certification as necessitated by the provisions  of
 20        section 33-5205(3)(g), Idaho Code;
 21        (b)  Accreditation of the school as necessitated by the provisions of sec-
 22        tion 33-5205(3)(e), Idaho Code; and
 23        (c)  Qualifications  of  a student for attendance at an alternative school
 24        as necessitated by the provisions of section 33-5208(3), Idaho Code; and
 25        (d)  The requirement that all employees of the school undergo  a  criminal
 26        history check as required by section 33-130, Idaho Code.
                                                                        
 27        SECTION  2.  This  act shall be in full force and effect on and after July
 28    1, 2000.

Statement of Purpose / Fiscal Impact


     
     
                STATEMENT OF PURPOSE 
                      RS 09636 
                           
     The purpose of this legislation is to better assure that charter schools employ the
     best available personnel who do not pose a threat to the safety and well being of
     fellow employees, students, volunteers or patrons of the school. 
     
     This legislation will amend ID Code 33-5210 to require employees of the school
     to undergo a criminal history check.
