  1                                        AN ACT
  2    RELATING TO PUBLIC WORKS CONTRACTORS; AMENDING SECTION 54-1903, IDAHO CODE, TO
  3        INCREASE THE VALUE OF WORK EXEMPT FROM THE PROVISIONS OF THIS CHAPTER.
                                                                        
  4    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
  5        SECTION 1.  That Section 54-1903, Idaho Code, be, and the same  is  hereby
  6    amended to read as follows:
                                                                        
  7        54-1903.  EXEMPTIONS. This act shall not apply to:
  8        (a)  An  authorized  representative  of  the United States government, the
  9    state of Idaho, or any incorporated town, city, county,  irrigation  district,
 10    reclamation  district  or other municipal or political corporation or subdivi-
 11    sion of this state.
 12        (b)  Officers of a court when they are acting within the  scope  of  their
 13    office.
 14        (c)  Public utilities operating under the jurisdiction of the public util-
 15    ities commission of the state of Idaho on construction, maintenance and devel-
 16    opment work incidental to their own business.
 17        (d)  The sale or installation of any finished products, materials or arti-
 18    cles  of merchandise, which are not actually fabricated into and do not become
 19    a permanent fixed part of the structure.
 20        (e)  Any construction, alteration, improvement or repair of personal prop-
 21    erty.
 22        (f)  Any construction, alteration, improvement or repair carried on within
 23    the limits and boundaries of any site or reservation, the title of which rests
 24    in the federal government.
 25        (g)  Any construction or operation  incidental  to  the  construction  and
 26    repair  of irrigation and drainage ditches of regularly constituted irrigation
 27    districts, drainage districts or reclamation districts, except when  performed
 28    by a person required to be licensed under this act.
 29        (h)  Duly  licensed  architects,  civil engineers, and land surveyors when
 30    acting solely in their professional capacity.
 31        (i)  Any construction, alteration,  improvement  or  repair  involving  an
 32    estimated cost of less than five ten thousand dollars ($510,000).
 33        (j)  Any  construction,  operation,  alteration  or maintenance of a solid
 34    waste disposal site including those operated by, for, or at the direction of a
 35    city or a county.
 36        (k)  Any construction, operation or repair carried on in  response  to  an
 37    emergency  that  has  been officially declared by the governor pursuant to the
 38    provisions of chapter 10, title 46, Idaho Code, or an emergency that has  been
 39    declared  by a governing body (city or county) in anticipation of a governor's
 40    declaration, for a period of time not to exceed seven (7) calendar days.

Statement of Purpose / Fiscal Impact


                STATEMENT OF PURPOSE
                       RS 09770

Any public works construction project over $5,000 requires the 
contractor to have a public works license.

The purpose of this bill is to change the limit to projects 
over $10,000. The proposed limit of $10,000 simply reflects 
inflation over the past 20 years. The last time the limit was 
adjusted was 1980, when the limit went from $1,000 to $5,000.

                      FISCAL IMPACT

There would be no fiscal impact to the state general fund. There 
could be modest savings to cities by having more competition for 
public works projects.
