State Board of Education and the Board of Regents of the University of
Idaho may not adopt a student matriculation fee which exceeds three percent

2 RELATING TO THE STATE BOARD OF EDUCATION AND BOARD OF REGENTS OF THE UNIVER-
3 SITY OF IDAHO; AMENDING CHAPTER 1, TITLE 33, IDAHO CODE, BY THE ADDITION
4 OF A NEW SECTION 33-105A, IDAHO CODE, TO PROVIDE THAT THE STATE BOARD OF
5 EDUCATION AND THE BOARD OF REGENTS OF THE UNIVERSITY OF IDAHO MAY NOT
6 ADOPT A STUDENT MATRICULATION FEE WHICH EXCEEDS THREE PERCENT OF THE RATE
7 OF THE STUDENT MATRICULATION FEE CHARGED FOR THE IMMEDIATELY PRECEDING
8 FISCAL YEAR.
9 Be It Enacted by the Legislature of the State of Idaho:
10 SECTION 1. That Chapter 1, Title 33, Idaho Code, be, and the same is
11 hereby amended by the addition thereto of a NEW SECTION, to be known and des-
12 ignated as Section 33-105A, Idaho Code, and to read as follows:
13 33-105A. MATRICULATION FEE. The state board of education and the board of
14 regents of the university of Idaho may not adopt a student matriculation fee
15 which exceeds three percent (3%) above the rate of the matriculation fee
16 charged for the immediately preceding fiscal year.
STATEMENT OF PURPOSE

This legislation will establish a 3% cap on increases in student matriculation fees
at the four year colleges and universities; University of Idaho, Idaho State
University, Boise State University and Lewis-Clark College. Overall resident
student fees are an average of 46% higher today than 5 years ago. The
matriculation fee average has changed from 2% ten years ago to its highest 12%
change in 1998. It will be the intent of this legislation to put a hold on raising the
matriculation fees more than 3% of the preceding year.
FISCAL NOTE
The direct impact of the 3% cap would be on the students. if the state picks up this
difference, there could be a $63 per student charge which is the difference
between the 3% cap and the average expenditure per year for the last five years.
