  1                                        AN ACT
  2    RELATING TO COUNTY FAIR  BOARDS;  AMENDING  SECTION  22-202,  IDAHO  CODE,  TO
  3        INCREASE  THE  POPULATION  THRESHOLD FROM SEVENTY-FIVE THOUSAND PERSONS TO
  4        TWO HUNDRED THOUSAND PERSONS AND  TO  MAKE  A  TECHNICAL  CORRECTION;  AND
  5        DECLARING AN EMERGENCY.
                                                                        
  6    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
  7        SECTION  1.  That  Section  22-202, Idaho Code, be, and the same is hereby
  8    amended to read as follows:
                                                                        
  9        22-202.  HEARING OF OBJECTIONS -- ORDER CREATING BOARD -- APPOINTMENT  AND
 10    SELECTION OF MEMBERS. The board shall meet on the day fixed, at which time any
 11    voter or taxpayer residing within the county may appear and object to the form
 12    of  the  petition,  the  genuineness  of the signatures, or may make any other
 13    objection as to the legality of the proceedings of the board; or,  any  perti-
 14    nent objection or objections to the creation of the county fair board.
 15        After hearing and considering the objections, if any, made to the proceed-
 16    ings  or  to the creation of a county fair board, the board shall, if it deems
 17    it for the best interests of the county that a county fair be conducted by the
 18    county, create a county fair board by an order duly spread upon its minutes.
 19        (A)  If the board in a county with a population of seventy-five  two  hun-
 20    dred thousand (75200,000) persons or less orders the creation of a county fair
 21    board,  it  shall  immediately appoint either five (5) or seven (7) persons to
 22    membership thereof, and shall fix the place within the county  at  which  such
 23    fair  shall be held, and make its action a matter of record. The members shall
 24    as nearly as possible be selected from the different industries and localities
 25    of the county. If seven  (7)  persons  are  appointed  on  January  18,  1988,
 26    appointments shall be made as follows: four (4) members shall be appointed for
 27    a term of two (2) years and three (3) members shall be appointed for a term of
 28    three  (3) years. Thereafter, each appointment shall be made for terms of four
 29    (4) years. Appointments shall expire on the third Monday in January.
 30        If five (5) persons are appointed on January 18, 1988, appointments  shall
 31    be made as follows: three (3) members shall be appointed for a term of two (2)
 32    years  and  two  (2) members shall be appointed for a term of three (3) years.
 33    Thereafter, each appointment shall be made  for  terms  of  three  (3)  years.
 34    Appointments  shall  expire on the third Monday in January. Any vacancy occur-
 35    ring on such county fair board shall be filled by appointment  by  the  county
 36    commissioners  at  their  first  regular  meeting after the occurrence of such
 37    vacancy.
 38        (B)  In a county with a population of seventy-five  two  hundred  thousand
 39    one  (75200,001)  or  more  persons, the board, if it orders the creation of a
 40    county fair board, shall immediately appoint either five (5) or seven (7) per-
 41    sons to membership thereon, in the manner provided herein.
 42        If seven (7) persons are appointed on January 17, 1977, appointments shall
 43    be made as follows: four (4) members shall be appointed for a term of two  (2)

  1    years  and three (3) members shall be appointed for a term of three (3) years.
  2    Thereafter, each appointment shall be  made  for  terms  of  four  (4)  years.
  3    Appointments shall expire on the third Monday in January.
  4        If  five (5) persons are appointed on January 17, 1977, appointments shall
  5    be made as follows: three (3) members shall be appointed for a term of two (2)
  6    years and two (2) members shall be appointed for a term of  three  (3)  years.
  7    Thereafter,  each  appointment  shall  be  made  for terms of three (3) years.
  8    Appointments shall expire on the third Monday in January.
  9        County fair boards created after the effective date of this act  shall  be
 10    appointed  for  staggered terms assuming that the appointments are made on the
 11    third Monday in January.
                                                                        
 12        SECTION 2.  An emergency existing  therefor,  which  emergency  is  hereby
 13    declared to exist, this act shall be in full force and effect on and after its
 14    passage and approval.

     The purpose of this legislation is to increase the population threshold from
     seventy-five thousand persons to two hundred thousand persons and to make a
     technical correction; and declaring an emergency.
