HEALTH INSURANCE - Amends House Bill No. 750 of the Second Regular Session
of the Fifty-fifth Idaho Legislature regarding the Idaho Individual High
Risk Reinsurance Pool to require that insurance carriers subject to the act
provide specified information to the Department of Insurance, the Joint
Legislative Oversight Committee and the Health Insurance Premiums Task
Force; and to provide that the confidentiality of any trade secrets or

  2    RELATING TO HEALTH INSURANCE; AMENDING SECTION  20  OF  HOUSE  BILL  NO.  750,
  3        ENACTED  BY  THE  SECOND REGULAR SESSION OF THE FIFTY-FIFTH IDAHO LEGISLA-
  4        TURE, TO REQUIRE THAT CARRIERS SUBJECT TO THE ACT PROVIDE  INFORMATION  TO
  5        THE  DEPARTMENT OF INSURANCE AND THE JOINT LEGISLATIVE OVERSIGHT COMMITTEE
  6        DEEMED NECESSARY TO FULFILL THE REQUIREMENTS OF  SECTION  20,  TO  PROVIDE
  7        THAT  THE  CONFIDENTIALITY OF ANY TRADE SECRETS OR PROPRIETARY INFORMATION
  8        RECEIVED BE MAINTAINED AND TO PROVIDE FOR PUBLIC DISCLOSURE OF INFORMATION
  9        UNDER SPECIFIED CIRCUMSTANCES; AND AMENDING SECTION 21 OF HOUSE  BILL  NO.
 10        750, ENACTED BY THE SECOND REGULAR SESSION OF THE FIFTY-FIFTH IDAHO LEGIS-
 11        LATURE,  TO REQUIRE THAT CARRIERS PROVIDE INFORMATION TO THE DEPARTMENT OF
 12        INSURANCE AND THE HEALTH INSURANCE PREMIUMS TASK FORCE DEEMED NECESSARY TO
 13        FULFILL THE REQUIREMENTS OF SECTION 21, TO PROVIDE THAT THE  CONFIDENTIAL-
 14        ITY OF ANY TRADE SECRETS OR PROPRIETARY INFORMATION RECEIVED BE MAINTAINED
 15        AND  TO  PROVIDE FOR PUBLIC DISCLOSURE OF INFORMATION UNDER SPECIFIED CIR-
 16        CUMSTANCES.
                                                                        
 17    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
 18        SECTION 1.  That Section 20 of House Bill No. 750, enacted by  the  Second
 19    Regular  Session  of  the  Fifty-fifth  Idaho Legislature, be, and the same is
 20    hereby amended to read as follows:
                                                                        
 21        SECTION 20. The President Pro Tempore of the  Senate  shall  appoint  five
 22    senators,  and  the Speaker of the House of Representatives shall appoint five
 23    representatives to act as a joint legislative oversight committee  to  monitor
 24    the effects of this act. The committee shall report its findings and recommen-
 25    dations  to the Second Regular Session of the Fifty-sixth Idaho Legislature in
 26    2002. Insurance carriers subject to the provisions of this act  shall  provide
 27    to  the  Department of Insurance and the joint legislative oversight committee
 28    all information deemed necessary to fulfill the requirements of this  section.
 29    The  department and the oversight committee shall maintain the confidentiality
 30    of any trade secrets or proprietary information exempt from public  disclosure
 31    under  the  provisions  of  Section 9-340D, Idaho Code, provided in accordance
 32    with this section. For purposes of this section, the  joint legislative  over-
 33    sight  committee  shall be deemed a public agency as that term is used in Sec-
 34    tion 9-340D, Idaho Code. The data and information may be compiled into compos-
 35    ite form and made public if information that could be  used  to  identify  the
 36    reporting insurer is removed.
                                                                        
 37        SECTION  2.  That  Section 21 of House Bill No. 750, enacted by the Second
 38    Regular Session of the Fifty-fifth Idaho Legislature,  be,  and  the  same  is
 39    hereby amended to read as follows:
                                                                        
 40        SECTION  21. Prior to the initial assessment for the Idaho Individual High
 41    Risk Reinsurance Pool of March 1, 2001, as provided for  in  Section  41-5508,

  1    Idaho  Code, the Health Insurance Premiums Task Force shall determine a method
  2    of limiting the assessments which may be imposed on carriers  providing  rein-
  3    surance  by way of excess or stop loss coverage and on carriers selling insur-
  4    ance in the individual market. The Health Insurance Premiums Task Force  shall
  5    also  review options regarding initially limiting enrollment in the Individual
  6    High Risk Reinsurance Pool in order to preserve the financial integrity of the
  7    pool. The carriers shall provide to the Department of Insurance and the Health
  8    Insurance Premiums Task Force all information deemed necessary to fulfill  the
  9    requirements of this section. The department and the task force shall maintain
 10    the  confidentiality  of  any  trade secrets or proprietary information exempt
 11    from public disclosure under the provisions of  Section  9-340D,  Idaho  Code,
 12    provided  in  accordance  with this section. For purposes of this section, the
 13    Health Insurance Premiums Task Force shall be deemed a public agency  as  that
 14    term  is  used  in Section 9-340D, Idaho Code. The data and information may be
 15    compiled into composite form and made public if information that could be used
 16    to identify the reporting insurer is removed.

This legislation allows the Department of Insurance and the Joint Legislative
Oversight Committee to review pertinent information provided by the Insurance
carriers in establishing Idaho's Individual High Risk Pool.
