  1                               A CONCURRENT RESOLUTION
  2    STATING FINDINGS OF THE LEGISLATURE AND ACKNOWLEDGING  RECEIPT  OF  THE  IDAHO
  3        WOLF  CONSERVATION  AND MANAGEMENT PLAN DATED APRIL 2000, AND RECOMMENDING
  4        THAT THE PLAN BE MADE AVAILABLE FOR PUBLIC COMMENT  AND  RETURNED  TO  THE
  5        IDAHO  WOLF  OVERSIGHT  COMMITTEE  FOR  FINAL REVIEW AND SUBMISSION TO THE
  6        FIRST REGULAR SESSION OF THE FIFTY-SIXTH IDAHO LEGISLATURE.
                                                                        
  7    Be It Resolved by the Legislature of the State of Idaho:
                                                                        
  8        WHEREAS, the process for removing gray wolves (Canis lupus) from the  list
  9    of  endangered species (delisting) under the Endangered Species Act, 16 U.S.C.
 10    1531 et seq., requires that a state have in place an adequate regulatory mech-
 11    anism to ensure that gray wolves will not again become  threatened  or  endan-
 12    gered; and
 13        WHEREAS,  the  regulatory  mechanism developed by the state must contain a
 14    management plan which will be used by the state when the U.S. Fish  and  Wild-
 15    life Service decides to delist gray wolves; and
 16        WHEREAS,  the  management plan must be approved by the U.S. Fish and Wild-
 17    life Service; and
 18        WHEREAS, the management plan must provide appropriate  guidance  to  Idaho
 19    officials  to  assure  that  this large, aggressive predator will not again be
 20    petitioned to be listed as threatened or endangered under the Endangered  Spe-
 21    cies Act; and
 22        WHEREAS, it is critical to the state that the management plan also provide
 23    maximum  protection  for  other important interests, such as game populations,
 24    domestic livestock, and private property interests; and
 25        WHEREAS, successful management of gray wolves after they are delisted will
 26    require an exceptional degree of cooperation and coordination among the states
 27    of Idaho, Montana and Wyoming; and
 28        WHEREAS, the Idaho Wolf Oversight Committee has worked for countless hours
 29    to bring a gray wolf management plan to the Idaho  Legislature  for  consider-
 30    ation.
 31        NOW,  THEREFORE,  BE IT RESOLVED by the members of the Second Regular Ses-
 32    sion of the Fifty-fifth Idaho Legislature, the House  of  Representatives  and
 33    the  Senate  concurring  therein, that the Legislature acknowledges receipt of
 34    the draft Idaho Wolf Conservation and Management Plan  dated  April  2000  and
 35    expresses appreciation for the work of the Idaho Wolf Oversight Committee. The
 36    Legislature  neither  accepts nor rejects the contents of the plan, but recog-
 37    nizes the importance of delisting and the necessity of a plan for  that  proc-
 38    ess.  Therefore,  we  recommend  that  the plan be submitted to the public for
 39    examination, criticism and comments and returned to the Idaho  Wolf  Oversight
 40    Committee  for final review and submission to the First Regular Session of the
 41    Fifty-sixth Idaho Legislature.

                 STATEMENT OF PURPOSE
                       RS 10359 
     
     This resolution puts in place a draft State Wolf Management Plan prior to a public
     comment process. 
     
     The State Wolf Oversight Committee has developed this draft plan after many
     months of work as part of the process required by the U.S. Fish and Wildlife
     Service in the delisting of wolves in Idaho. Delisting will be necessary in order for
     Idaho to have authority to permanently manage these predators. This resolution
     indicates that the Legislature neither accepts or rejects the draft plan. 
     
     After a period of public comment, this plan will return to the Legislature for final
     approval. 
     
     
     
                    FISCAL IMPACT 
     
     There will be a minor impact on the budget of the Fish & Game Department.
