PUBLIC SCHOOL PERMANENT ENDOWMENT FUND - Proposes an amendment to the
Constitution of the State of Idaho, relating to the Public School Fund, to
change the name of the Public School Fund to the Public School Permanent
Endowment Fund; to provide that the fund shall consist of proceeds from the
sale of school lands and amounts allocated from the Public School Earnings
Reserve Fund; to provide that proceeds from the sale of school lands may be
deposited into a land bank fund to be used to acquire other lands within
the state; and to provide that if those proceeds are not used to acquire
other lands within a time provided by the Legislature, the proceeds shall
be deposited into the Public School Permanent Endowment Fund, along with

  1                                  A JOINT RESOLUTION
  2    PROPOSING AN AMENDMENT TO SECTION 4, ARTICLE IX OF  THE  CONSTITUTION  OF  THE
  3        STATE  OF IDAHO, RELATING TO THE PUBLIC SCHOOL FUND, TO CHANGE THE NAME OF
  4        THE PUBLIC SCHOOL FUND TO THE PUBLIC SCHOOL PERMANENT ENDOWMENT  FUND,  TO
  5        PROVIDE  THAT  THE  FUND SHALL CONSIST OF PROCEEDS FROM THE SALE OF SCHOOL
  6        LANDS AND AMOUNTS ALLOCATED FROM THE PUBLIC SCHOOL EARNINGS RESERVE  FUND,
  7        TO  PROVIDE   THAT PROCEEDS FROM THE SALE OF SCHOOL LANDS MAY BE DEPOSITED
  8        INTO A LAND BANK FUND TO BE USED TO ACQUIRE OTHER LANDS WITHIN THE  STATE,
  9        TO  PROVIDE  THAT  IF  THOSE  PROCEEDS ARE NOT USED TO ACQUIRE OTHER LANDS
 10        WITHIN A TIME PROVIDED BY THE LEGISLATURE, THE PROCEEDS SHALL BE DEPOSITED
 11        INTO THE PUBLIC SCHOOL PERMANENT ENDOWMENT FUND ALONG WITH ANY EARNINGS ON
 12        THE PROCEEDS; STATING THE QUESTION TO  BE  SUBMITTED  TO  THE  ELECTORATE;
 13        DIRECTING  THE  LEGISLATIVE  COUNCIL TO PREPARE THE STATEMENTS REQUIRED BY
 14        LAW; AND DIRECTING THE SECRETARY OF STATE TO  PUBLISH  THE  AMENDMENT  AND
 15        ARGUMENTS AS REQUIRED BY LAW.
                                                                        
 16    Be It Resolved by the Legislature of the State of Idaho:
                                                                        
 17        SECTION  1.  That  Section 4, Article IX, of the Constitution of the State
 18    of Idaho be amended to read as follows:
                                                                        
 19             SECTION 4.  PUBLIC SCHOOL PERMANENT ENDOWMENT FUND DEFINED.  The
 20        public  school permanent endowment fund of the state shall consist of
 21        the proceeds from the sale of such  lands  as  have  heretofore  been
 22        granted,  or  may  hereafter  be granted, to the state by the general
 23        government, known as school lands, and those granted in lieu of such;
 24        lands acquired by gift or grant from any person or corporation  under
 25        any  law  or grant of the general government; and of all other grants
 26        of land or money made to the state from the  general  government  for
 27        general  educational  purposes,  or where no other special purpose is
 28        indicated in such  grant;  all  estates  or  distributive  shares  of
 29        estates that may escheat to the state; all unclaimed shares and divi-
 30        dends  of  any  corporation incorporated under the laws of the state;
 31        all other grants, gifts, devises, or bequests made to the  state  for
 32        general  educational  purposes; and amounts allocated from the public
 33        school earnings reserve fund. Provided however,  that  proceeds  from
 34        the sale of school lands may be deposited into a land bank fund to be
 35        used  to  acquire  other  lands  within  the state for the benefit of
 36        endowment beneficiaries. If those proceeds are not  used  to  acquire
 37        other  lands  within a time provided by the legislature, the proceeds
 38        shall be deposited into the public school  permanent  endowment  fund
 39        along with any earnings on the proceeds.
                                                                        
 40        SECTION  2.  The  question to be submitted to the electors of the State of
 41    Idaho at the next general election shall be as follows:
 42        "Shall Section 4, Article IX of the Constitution of the State of Idaho  be

  1    amended to:
  2        1.  Change  the name of the Public School Fund to the Public School Perma-
  3    nent Endowment Fund;
  4        2.  Provide that the fund shall consist  of  proceeds  from  the  sale  of
  5    school  lands  and  amounts  allocated from the Public School Earnings Reserve
  6    Fund;
  7        3.  Provide that proceeds from the sale of school lands may  be  deposited
  8    into a land bank fund to be used to acquire other lands within the state; and
  9        4.  To  provide that if those proceeds are not used to acquire other lands
 10    within a time provided by the legislature, the  proceeds  shall  be  deposited
 11    into the Public School Permanent Endowment Fund along with any earnings on the
 12    proceeds?".
                                                                        
 13        SECTION  3.  The Legislative Council is directed to prepare the statements
 14    required by Section 67-453, Idaho Code, and file the same.
                                                                        
 15        SECTION 4.  The Secretary of State is hereby directed to publish this pro-
 16    posed constitutional amendment and arguments as required by law.

A joint resolution proposing an amendment to Section 4, Article 
IX of the Idaho Constitution, relating to the public school fund. 
To change the name of the fund to "Public School Permanent
Endowment Fund." To provide that the fund shall consist of 
proceeds from the sale of school lands and amounts allocated 
from the earnings reserve fund and that they be deposited 
into a Land Bank fund.
