23 TION 49-418, IDAHO CODE, TO ALLOW THE SURVIVING SPOUSE OF A DECEASED QUAL-
24 IFIED VETERAN TO RETAIN AND DISPLAY THE VETERAN LICENSE PLATE ON A VEHICLE
25 OWNED BY THE SURVIVING SPOUSE, TO ALLOW THE SURVIVING SPOUSE TO REAPPLY
26 FOR THE PLATES IF THE DECEASED QUALIFIED VETERAN DIED WITHIN FIVE YEARS OF
27 REAPPLICATION FOR THE LICENSE PLATES AND TO MAKE A TECHNICAL CORRECTION;
28 AND DECLARING AN EMERGENCY.
29 SECTION 1. That Section 49-403A, Idaho Code, be, and the same is hereby
30 amended to read as follows:
31 49-403A. PURPLE HEART RECIPIENT -- LICENSE PLATES. (1) Purple heart
32 recipient license plates are available to any applicant who is a veteran or an
33 active or retired member of any of the armed forces of the United States,
34 reserve forces or Idaho national guard, and who furnishes proof of entitlement
35 by providing one (1) of the following documents:
36 (a) A copy of form DD214 or equivalent document showing an award of the
37 purple heart medal;
38 (b) A copy of the certificate presented with the medal; or
39 (c) A copy of the military order describing the award of the medal to the
40 applicant.
41 (2) In addition to the regular registration fee, the applicant shall be
42 charged the plate fee required in section 49-450, Idaho Code. Whenever title
43 or interest in a vehicle registered under the provisions of this section is
44 transferred or assigned, the registration shall expire, but the purple heart

1 recipient may transfer his plates to another vehicle upon payment of the
2 required transfer fees. He may only display the plates after receipt of new
3 registration from the department. A purple heart recipient shall not register
4 more than two (2) vehicles under the provisions of this section.
5 (3) Purple heart recipient license plates may be retained and displayed
6 on vehicles owned by the surviving spouse of a deceased purple heart recipi-
7 ent. In addition, the surviving spouse of a deceased purple heart recipient is
8 eligible to reapply for and shall be issued purple heart recipient license
9 plates if the deceased purple heart recipient died on or after January 1 of
10 the five (5) years preceding the date of reapplication for the plates. Such
11 plates shall be used on a vehicle owned by the surviving spouse.
12 (4) The purple heart recipient license plates shall be of a color and
13 design acceptable to the military order of the purple heart association and
14 approved by the department, utilizing a numbering system as determined by the
15 department.
16 SECTION 2. That Section 49-415, Idaho Code, be, and the same is hereby
17 amended to read as follows:
18 49-415. FORMER PRISONER OF WAR LICENSE PLATES. (1) Any veteran, who was a
19 prisoner of war (POW) of an armed enemy of the United States during active
20 service in the armed forces of the United States, that service occurring dur-
21 ing any portion of a recognized war period enumerated in this section, and who
22 has been released or discharged from the armed forces under other than dishon-
23 orable conditions, may upon application to the department, register and
24 receive for not more than two (2) motor vehicles, special former prisoner of
25 war license plates in lieu of regular license plates. The provisions of this
26 section shall not apply to any vehicle with a registered maximum gross weight
27 over sixteen thousand (16,000) pounds.
28 (2) In addition to the regular registration fees required in section
29 49-402(1) or 49-434(1), Idaho Code, the applicant shall pay the plate fee
30 required in section 49-450, Idaho Code. Whenever a former prisoner of war
31 transfers or assigns his title or interest to a vehicle registered under this
32 section the registration shall expire, but the former prisoner of war may hold
33 the special plates and may have them transferred to another vehicle upon pay-
34 ment of the required transfer fee provided in section 49-431, Idaho Code. He
35 may only display the plates after receipt of the new registration document
36 from the department.
37 (3) Former prisoner of war license plates shall bear the words "Former
38 Prisoner of War" and a declaration of the period of service, and shall in all
39 other respects be as provided by law.
40 (4) Recognized war periods for the purpose of this section shall be any
41 period of war recognized by the United States department of veterans affairs
42 for the purpose of awarding federal veterans benefits as may be defined in
43 title 38, U.S. code, chapter 1, section 101(11).
44 (5) Former prisoner of war license plates may be retained and displayed
45 on vehicles owned by the surviving spouse of a deceased former prisoner of
46 war. In addition, the surviving spouse of the deceased former prisoner of war
47 is eligible to reapply for and shall be issued former prisoner of war license
48 plates if the deceased former prisoner of war died on or after January 1 of
49 the five (5) years preceding the date of reapplication for the plates. Such
50 plates shall be used on a vehicle owned by the surviving spouse.
51 SECTION 3. That Section 49-415A, Idaho Code, be, and the same is hereby
52 amended to read as follows:

1 49-415A. CONGRESSIONAL MEDAL OF HONOR LICENSE PLATES. (1) Congressional
2 medal of honor license plates are available to applicants who furnish proof of
3 entitlement by certification from the United States Veterans Administration
4 attesting to their status as a congressional medal of honor recipient.
5 (2) The license plates shall be provided free of charge. The applicant
6 shall pay the regular annual registration fees required by section 49-402 or
7 49-434(1), Idaho Code. The provisions of this section shall not apply to any
8 vehicle with a registered maximum gross weight over sixteen thousand (16,000)
9 pounds. If the plate holder transfers his title or interest to a vehicle reg-
10 istered under this section, the plates may be transferred to another vehicle
11 owned by the plate holder. If the plates are unexpired, the plate holder shall
12 be given credit for the unexpired portion of the registration fee against the
13 new registration fee. The transfer fee specified by section 49-431(1), Idaho
14 Code, shall apply.
15 (3) These provisions shall apply to the vehicle to which the plates were
16 originally issued and to any vehicle subsequently purchased and owned by the
17 medal of honor recipient, except that the privilege shall not extend to more
18 than two (2) vehicles at a time.
19 (4) Congressional medal of honor license plates may be retained and dis-
20 played on vehicles owned by the surviving spouse of a deceased congressional
21 medal of honor recipient. In addition, the surviving spouse of a deceased con-
22 gressional medal of honor recipient is eligible to reapply for and shall be
23 issued congressional medal of honor license plates if the deceased congressio-
24 nal medal of honor recipient died on or after January 1 of the five (5) years
25 preceding the date of reapplication for the plates. Such plates shall be used
26 on a vehicle owned by the surviving spouse.
27 SECTION 4. That Section 49-415B, Idaho Code, be, and the same is hereby
28 amended to read as follows:
29 49-415B. PEARL HARBOR SURVIVOR SPECIAL PLATES. (1) Any veteran who was on
30 active duty in the armed forces of the United States and assigned or stationed
31 at Pearl Harbor, Hawaii, or within three (3) miles of the island of Oahu on
32 December 7, 1941, and who has been released or discharged from the armed
33 forces under other than dishonorable conditions, may upon application to the
34 department, register and receive for not more than two (2) motor vehicles,
35 special Pearl Harbor survivor number plates in lieu of regular number plates.
36 The provisions of this section shall not apply to any vehicle with a regis-
37 tered maximum gross weight over sixteen thousand (16,000) pounds.
38 (2) In addition to the regular registration fees required in section
39 49-402(1) or 49-434(1), Idaho Code, the applicant shall be charged the plate
40 fee required in section 49-450, Idaho Code. Whenever a qualifying survivor of
41 the Japanese attack on Pearl Harbor on December 7, 1941, transfers or assigns
42 his title or interest to a vehicle especially registered under this section,
43 the registration shall expire, but the Pearl Harbor survivor may hold his spe-
44 cial plates which he may have reissued to him upon the payment of the required
45 transfer fees. He may only display those plates after receipt of a new regis-
46 tration from the department.
47 (3) Pearl Harbor survivor plates shall bear the characters: "Pearl Harbor
48 Survivor" and shall in all other respects be as provided by law.
49 (4) Pearl Harbor survivor license plates may be retained and displayed on
50 vehicles owned by the surviving spouse of a deceased Pearl Harbor survivor
51 veteran. In addition, the surviving spouse of a deceased Pearl Harbor survivor
52 veteran is eligible to reapply for and shall be issued Pearl Harbor survivor
53 license plates if the deceased Pearl Harbor survivor veteran died on or after

1 January 1 of the five (5) years preceding the date of reapplication for the
2 plates. Such plates shall be used on a vehicle owned by the surviving spouse.
3 SECTION 5. That Section 49-418, Idaho Code, be, and the same is hereby
4 amended to read as follows:
5 49-418. VETERANS PLATES. (1) Any person who is the owner of a vehicle
6 registered under the provisions of section 49-402 or 49-434(1), Idaho Code,
7 may apply for and upon department approval receive special veterans license
8 plates in lieu of regular license plates. The provisions of this section shall
9 not apply to any vehicle with a registered maximum gross weight over sixteen
10 thousand (16,000) pounds. Availability of veterans plates for other vehicles
11 shall be subject to the rules, policies and procedures of the department.
12 (2) Proof of being a current or former member of the United States armed
13 forces must be furnished to the department before special veterans plates will
14 be issued. Acceptable proof shall be a copy of form DD214 or an equivalent
15 document or statement from the department of veterans affairs.
16 (3) In addition to the regular registration fees required in section
17 49-402(1) or 49-434(1), Idaho Code, the applicant shall pay the initial pro-
18 gram fee and the annual program fee specified in section 49-402, Idaho Code,
19 and the plate fee specified in section 49-450, Idaho Code.
20 (4) Whenever title or interest in a vehicle registered under the provi-
21 sions of this section is transferred or assigned, the owner may transfer the
22 special plates to another vehicle upon payment of the required transfer fees.
23 The owner may only display the plates on another vehicle upon receipt of the
24 new registration from the department.
25 (5) The veterans license plate design shall include the colors red, white
26 and blue, shall designate one (1) of the five (5) branches of military ser-
27 vice, and display either:
28 (a) The word "VETERAN"; or
29 (b) The name of a conflict or war period recognized by the United States
30 department of veterans affairs for the purpose of awarding federal vet-
31 erans benefits as defined in 38 U.S.C. 101(11).
32 The license plate design shall comply with all applicable rules of the depart-
33 ment, and shall include a separate and distinct numbering system. The design,
34 color, and numbering system shall be subject to approval of the department.
35 (6) Veterans license plates may be retained and displayed on vehicles
36 owned by the surviving spouse of a qualified veteran. In addition, the surviv-
37 ing spouse of a deceased qualified veteran is eligible to reapply for and
38 shall be issued veterans license plates if the deceased qualified veteran died
39 on or after January 1 of the five (5) years preceding the date of reapplica-
40 tion for the plates. Such plates shall be used on a vehicle owned by the sur-
41 viving spouse.
42 SECTION 6. An emergency existing therefor, which emergency is hereby
43 declared to exist, this act shall be in full force and effect on and after its
44 passage and approval.

9 On page 2, in line 27, following "recipient." insert: "In addition, the

13 January 1 of the five (5) years preceding the date of reapplication for the

15 spouse.".
16 AMENDMENT TO SECTION 3
17 On page 3, in line 1, following "veteran." insert: "In addition, the sur-
18 viving spouse of a deceased Pearl Harbor survivor veteran is eligible to reap-
19 ply for and shall be issued Pearl Harbor survivor license plates if the
20 deceased Pearl Harbor survivor veteran died on or after January 1 of the five
21 (5) years preceding the date of reapplication for the plates. Such plates
22 shall be used on a vehicle owned by the surviving spouse.".
23 AMENDMENT TO SECTION 4
24 On page 3, in line 35, following "veteran." insert: "In addition, the sur-
25 viving spouse of a deceased qualified veteran is eligible to reapply for and
26 shall be issued veterans license plates if the deceased qualified veteran died
27 on or after January 1 of the five (5) years preceding the date of reapplica-
28 tion for the plates. Such plates shall be used on a vehicle owned by the sur-
29 viving spouse.".
30 AMENDMENT TO THE BILL
31 On page 1, following line 16 insert:

STATEMENT OF PURPOSE
RS 09455
The purpose of this legislation is to allow surviving spouses
of veterans to retain certain special military license plates,
and continue displaying them on vehicles after the death of the
qualifying individual who originally obtained the plates. Plate
programs included with this proposal are:
Former Prisoner of War, Congressional Medal of Honor, Pearl Harbor
Survivor, and Veterans.
Prior legislation has provided this accommodation for the Purple
Heart Recipient special plate program.
FISCAL IMPACT
No fiscal impact is anticipated with this legislation. Surviving
spouses will be paying registration fees and special plate program
fees as applicable.
