  1                                        AN ACT
  2    RELATING TO PROGRAMS FOR OLDER PERSONS; AMENDING SECTION 67-5008, IDAHO  CODE,
  3        TO  DELETE  THE  REQUIREMENT  THAT  ANY INCREASES IN STATE FUNDING FOR THE
  4        STATE SENIOR SERVICES PROGRAM MUST BE EXPENDED  FOR  IN-HOME  SERVICES  OR
  5        ADULT  DAY CARE AND TO MAKE TECHNICAL CORRECTIONS; AND PROVIDING AN EFFEC-
  6        TIVE DATE.
                                                                        
  7    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
  8        SECTION 1.  That Section 67-5008, Idaho Code, be, and the same  is  hereby
  9    amended to read as follows:
                                                                        
 10        67-5008.  PROGRAMS  FOR OLDER PERSONS. The commission shall upon reviewing
 11    recommendations from local area councils on aging, as required  by  the  Older
 12    Americans  Act of 1965, as amended, allocate to local designated area agencies
 13    grants or contracts for the following purposes:
 14        (1)  Transportation -- For operating expenses only.
 15        (2)  Congregate meals -- For direct costs to  provide  nutritionally  bal-
 16    anced meals to older persons at congregate meal sites.
 17        (3)  In-home   services  --  For  direct  provision  of  case  management,
 18    homemaker, chore, telephone reassurance, home delivered meals, friendly visit-
 19    ing, shopping assistance, in-home respite and other in-home services to  older
 20    persons  living  in non-institutional noninstitutional circumstances. Fees for
 21    specific services shall be based upon a variable schedule, according to  regu-
 22    lations rules established by the Idaho commission on aging, based upon ability
 23    to pay for such services.
 24        (4)  Adult day care -- For direct services to older persons and their care
 25    givers caregivers.
 26        (5)  Any  increases in state funding for the state senior services program
 27    after state fiscal year 1982 must be expended for in-home  services  or  adult
 28    day care.
                                                                        
 29        SECTION  2.  This  act shall be in full force and effect on and after July
 30    1, 2000.

                      STATEMENT OF PURPOSE
                            RS09421 
The proposed legislation deletes subsection (5), Section 67-5008, 
Idaho Code.  This will allow state funds for the senior services 
program to be used for all four types of services identified in 
subsections (1) through (4). The current law restricts state funding 
to only in-home services and adult day care.
