may purchase equipment with a price not to exceed twenty thousand dollars
at a public auction if the highway district board of commissioners has made

  1                                        AN ACT
  2    RELATING TO EQUIPMENT PURCHASES BY  HIGHWAY  DISTRICTS;  AMENDING  CHAPTER  9,
  3        TITLE  40,  IDAHO  CODE,  BY  THE ADDITION OF A NEW SECTION 40-906A, IDAHO
  4        CODE, TO PROVIDE THAT A HIGHWAY DISTRICT MAY  PURCHASE  EQUIPMENT  WITH  A
  5        PRICE  NOT  TO  EXCEED  TWENTY THOUSAND DOLLARS AT A PUBLIC AUCTION IF THE
  6        HIGHWAY DISTRICT BOARD OF COMMISSIONERS  HAS  MADE  A  FINDING  THAT  SUCH
  7        EQUIPMENT  MAY BE PURCHASED AT A LOWER PRICE THAN IS AVAILABLE ON THE MAR-
  8        KET.
                                                                        
  9    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
 10        SECTION 1.  That Chapter 9, Title 40, Idaho Code,  be,  and  the  same  is
 11    hereby  amended by the addition thereto of a NEW SECTION, to be known and des-
 12    ignated as Section 40-906A, Idaho Code, and to read as follows:
                                                                        
 13        40-906A.  EQUIPMENT PURCHASE AT PUBLIC AUCTION. Notwithstanding the provi-
 14    sions of section 40-906, Idaho Code, in its discretion, a highway district may
 15    purchase equipment  with  a  price  not  to  exceed  twenty  thousand  dollars
 16    ($20,000)  at a public auction, if the highway district board of commissioners
 17    has made a finding that such equipment may be purchased at a lower price  than
 18    is available on the market.

  1                                AMENDMENT TO SECTION 1
  2        On page 1 of the printed bill, in line 14, following  "equipment"  insert:
  3    "with a price not to exceed twenty thousand dollars ($20,000)".
                                                                        
  4                                 CORRECTION TO TITLE
  5        On  page  1, in line 4, following "EQUIPMENT" insert: "WITH A PRICE NOT TO
  6    EXCEED TWENTY THOUSAND DOLLARS".

                STATEMENT OF PURPOSE 
                      RS 09958 
                           
     This legislation creates a new section of Idaho Code section 40-906(A), Title 40,
     to allow highway district commissioners to purchase equipment at public auction. 
     In some cases, equipment may be purchased at a less expensive rate through a
     public auction.
