SENATE BILL NO. 1475, As Amended in the House
BY HEALTH AND WELFARE COMMITTEE
1 AN ACT
2 RELATING TO MEMBERSHIP OF THE BOARD OF NURSING; AMENDING SECTION 54-1403,
3 IDAHO CODE, TO STRIKE CERTAIN SPECIFIC EDUCATION REQUIREMENTS FOR MEMBER-
4 SHIP; AND DECLARING AN EMERGENCY.
5 Be It Enacted by the Legislature of the State of Idaho:
6 SECTION 1. That Section 54-1403, Idaho Code, be, and the same is hereby
7 amended to read as follows:
8 54-1403. BOARD OF NURSING. (1) Appointment, Removal and Term of Office.
9 There is hereby created within the department of self-governing agencies the
10 board of nursing for the state of Idaho composed of nine (9) members appointed
11 by the governor. Membership of the board shall consist of the following:
12 (a) Five (5) persons licensed to practice professional nursing in Idaho,
13 of whom three (3) shall be educated at the associate degree level provided
14 that one (1) of these may be a diploma nurse, and two (2) of whom shall be
15 educated at the baccalaureate, master's or doctoral level including, but
16 not limited to, persons educated with an associate degree or baccalaureate
17 degree in nursing;
18 (b) Two (2) persons licensed to practice practical nursing in Idaho;
19 (c) One (1) person licensed as an advanced practice nurse; and
20 (d) One (1) person who is a lay person to health care occupations.
21 In making appointments to the board, consideration shall be given to the
22 board's responsibility in areas of education and practice. Members of the
23 board of nursing and of the advisory council for licensed practical nurses
24 holding office under prior law on the effective date of this act shall serve
25 as members of the board created herein until expiration of their respective
26 terms and, as those terms expire or become vacant, the governor shall appoint
27 such other persons as will constitute a complete board as herein prescribed.
28 The two (2) members appointed to reach the full membership provided herein
29 shall be persons licensed to practice professional nursing educated at the
30 associate degree level. Persons may be reappointed to the board so long as
31 they meet the qualifications of the position to which they were originally
32 appointed. In the event that a member has attained an additional degree of
33 education, they may not be reappointed to represent the board position desig-
34 nated for another specific degree of education. Upon expiration of any term or
35 creation of any vacancy, the board shall notify the governor thereof, who then
36 shall make such appointment or fill such vacancy within sixty (60) days.
37 Appointments shall be for terms of four (4) years except appointments to
38 vacancies which shall be for the unexpired term being filled. No member shall
39 be appointed for more than three (3) consecutive terms. The governor may
40 remove any member from the board for neglect of any duty required by law or
41 for incompetency or unprofessional or dishonorable conduct.
42 (2) Qualifications of Members. No person is qualified for appointment
43 hereunder unless that person is a citizen of the United States and a resident

1 of the state of Idaho. Members required to be licensed hereunder shall not be
2 qualified for appointment to the board unless actively engaged in some field
3 of nursing in Idaho at the time of appointment. No person is qualified for
4 appointment as the lay member of the board if the person or his spouse is
5 licensed in any health occupation; is an employee, officer or agent of or has
6 any financial interest in any health care facility, institution, or associa-
7 tion or any insurance company authorized to underwrite health care insurance;
8 or is engaged in the governance and administration of any health care facil-
9 ity, institution or association.
10 (3) Conduct of Business. The board shall meet at such times as required
11 to conduct the business of the board and shall annually elect from its members
12 a chairman, vice chairman and such other officers as may be desirable. Five
13 (5) members shall constitute a quorum and the vote of a majority of members
14 present at a meeting wherein a quorum is present shall determine the action of
15 the board. Each member of the board shall be compensated as provided by sec-
16 tion 59-509(h), Idaho Code.
17 SECTION 2. An emergency existing therefor, which emergency is hereby
18 declared to exist, this act shall be in full force and effect on and after its
19 passage and approval.

2 On page 1 of the printed bill, in line 15, following "level" insert:
3 "including, but not limited to, persons educated with an associate degree or
4 baccalaureate degree in nursing".
STATEMENT OF PURPOSE
RS 10053
The purpose of this legislation is to clarify the composition of the Board of
Nursing. Current language is confusing, cumbersome, and, in at least one case,
redundant.
FISCAL NOTE
This legislation has no impact on the general fund, the Board of Nursing budget,
or on any associated fees.
