SENATE BILL NO. 1484, As Amended
BY EDUCATION COMMITTEE
1 AN ACT
2 RELATING TO POWERS AND DUTIES OF THE BOARD OF TRUSTEES OF A SCHOOL DISTRICT;
3 AMENDING CHAPTER 5, TITLE 33, IDAHO CODE, BY THE ADDITION OF A NEW SECTION
4 33-512C, IDAHO CODE, TO REQUIRE AN ANNUAL INSPECTION OF FACILITIES, A
5 REPORT TO THE BOARD OF TRUSTEES, AND PUBLICATION OF A SUMMARY OF THE
6 REPORT.
7 Be It Enacted by the Legislature of the State of Idaho:
8 SECTION 1. That Chapter 5, Title 33, Idaho Code, be, and the same is
9 hereby amended by the addition thereto of a NEW SECTION, to be known and des-
10 ignated as Section 33-512C, Idaho Code, and to read as follows:
11 33-512C. ANNUAL INSPECTION. It shall be the duty of the board of trustees
12 of every school district at least once in every school year to require an
13 independent inspection of the district's school facilities to determine
14 whether those school facilities comply with the health and safety standards
15 made applicable to the district by statute or by rule of the state board of
16 education. The inspection of facilities shall be done pursuant to section
17 39-4130, Idaho Code, or pursuant to any alternative, comparable, or more
18 demanding inspection of facilities authorized by rule of the state board of
19 education. The results of the inspection shall be presented to the board of
20 trustees for their review and consideration. A summary of the report listing
21 specific health and safety defects, by school, shall be published not more
22 than two (2) weeks following the presentation to the trustees, in a newspaper
23 of general circulation within the district. The specific requirements of the
24 advertisement of the summary report shall be prescribed by rule of the state
25 board of education and shall include, but is not limited to, a listing by
26 school of the health or safety item(s) that need repair and the estimated cost
27 of the repairs. A complete copy of the report shall be available to the public
28 in the office of the school district.

1 AMENDMENTS TO SECTION 1
2 On page 1 of the printed bill, in line 22, delete "one (1) week" and
3 insert: "two (2) weeks"; and in line 23, following "district." insert: "The
4 specific requirements of the advertisement of the summary report shall be pre-
5 scribed by rule of the state board of education and shall include, but is not
6 limited to, a listing by school of the health or safety item(s) that need
7 repair and the estimated cost of the repairs.".
STATEMENT OF PURPOSE
RS 10109
The purpose of this legislation is to require publication of, in
the local newspaper, a listing by school of identified health and
safety needs in a school district's buildings. The goal is to ensure
that patrons are aware of these issues and to build a climate for
support for funding the fixes needed to ensure our public schools
are safe for our children.
FISCAL IMPACT
There will be a fiscal impact on school districts that are required
to publish the list of health and safety needs in the local district.
The fiscal impact will vary by district due to cost variation in
advertising in newspapers and to the length of the list to be
published.
