                                    SENATE BILL NO. 1509
                                                                        
                              BY HEALTH AND WELFARE COMMITTEE
                                                                        
  1                                        AN ACT
  2    RELATING TO THE IDAHO BOARD OF PHARMACY; AMENDING SECTION 54-1716, IDAHO CODE,
  3        TO PROVIDE THAT THE BOARD'S CHIEF CONTROLLED SUBSTANCE INVESTIGATOR  IS  A
  4        NONCLASSIFIED EMPLOYEE; AND DECLARING AN EMERGENCY.
                                                                        
  5    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
  6        SECTION  1.  That  Section 54-1716, Idaho Code, be, and the same is hereby
  7    amended to read as follows:
                                                                        
  8        54-1716.  EMPLOYEES. (1) The board of pharmacy  may,  in  its  discretion,
  9    employ  persons  in addition to the executive director in such other positions
 10    or capacities as it deems necessary to the proper conduct  of  board  business
 11    and to the fulfillment of the board's responsibilities as defined by this act.
 12        (2)  The  employees of the board other than the executive director and the
 13    board's chief controlled substance investigator under chapter  27,  title  37,
 14    Idaho  Code, shall be classified employees and shall receive, as compensation,
 15    an annual salary payable on regular pay periods, the amount of which shall  be
 16    determined  by  the  personnel commission classification and compensation plan
 17    set forth in section 67-5309, Idaho Code, and reimbursement for  all  expenses
 18    incurred in connection with performance of their official duties.
                                                                        
 19        SECTION  2.  An  emergency  existing  therefor,  which emergency is hereby
 20    declared to exist, this act shall be in full force and effect on and after its
 21    passage and approval.
