SPEAKER Requested by: Division of Military 1 AN ACT 2 RELATING TO THE STATE MILITIA; AMENDING SECTION 46-314, IDAHO CODE, TO EXTEND 3 THE AUTHORITY OF THE ADJUTANT GENERAL TO PROVIDE INCENTIVE PAYMENTS FOR 4 REGISTRATION FEES AND TUITION FOR IDAHO NATIONAL GUARD MEMBERS ATTENDING 5 PRIVATE INSTITUTIONS OF HIGHER EDUCATION IN IDAHO. 6 Be It Enacted by the Legislature of the State of Idaho: 7 SECTION 1. That Section 46-314, Idaho Code, be, and the same is hereby 8 amended to read as follows: 9 46-314. EDUCATIONAL ENCOURAGEMENT. The adjutant general of the Idaho 10 national guard is authorized to encourage recruitment and retention of 11 nontechnician national guardsmen by providing incentive payments as set forth 12 hereinafter. The adjutant general may authorize the payment of not more than 13 one hundred percent (100%) of student registration fees or tuition for each 14 semester for each member of the active Idaho national guard who attends a pub- 15 lic or private institution of higher education in Idaho, a vocational educa- 16 tion school, or a community college organized under the provisions of chapter 17 21, title 33, Idaho Code. To be eligible to receive benefits, an individual 18 must be a member in good standing of the active Idaho national guard at the 19 beginning of and throughout the entire semester for which benefits are 20 received.
STATEMENT OF PURPOSE

This proposal expands the "educational encouragement" program to
permit national guard members to use this program when properly
enrolled in both state colleges and universities as well as private,
non-state institutions of higher education located within the state
of Idaho.
FISCAL IMPACT
There is no fiscal impact from this proposal. The actual funding
for the educational encouragement program is separate from and not
affected by this proposal.
