  1                                        AN ACT
  2    RELATING TO THE DEPARTMENT OF  AGRICULTURE;  AMENDING  SECTION  71-402,  IDAHO
  3        CODE,  TO  DELETE  THE PROHIBITION AGAINST ISSUING WEIGHMASTER LICENSES TO
  4        APPLICANTS WHO HAVE BEEN CONVICTED OF ANY FELONY WITHIN FIVE YEARS OR HAVE
  5        PAID ANY FINE OR COMPLETED ANY SENTENCE  OF  CONFINEMENT  FOR  ANY  FELONY
  6        WITHIN FIVE YEARS.
                                                                        
  7    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
  8        SECTION  1.  That  Section  71-402, Idaho Code, be, and the same is hereby
  9    amended to read as follows:
                                                                        
 10        71-402.  LICENSING OF WEIGHMASTERS. Any person acting as a  public  weigh-
 11    master of grains, dry peas, potato starch, dry beans, leguminous and all other
 12    small seeds, hay, wool, bulk potatoes, bulk fertilizers, sugar beets and feeds
 13    (not including minerals) or any of them shall make application to the director
 14    of the department for a weighmaster's license. Application for a weighmaster's
 15    license  shall be in writing on a form prescribed by the director. Each appli-
 16    cant shall furnish satisfactory evidence of good moral character,  ability  to
 17    weigh  accurately  and  to  make  correct  weight tickets. Upon receipt of the
 18    application with satisfactory evidence of qualifications, on or before July 1,
 19    1949, and annually thereafter, and a license fee of ten dollars ($10.00),  the
 20    director shall issue an annual weighmaster's license. No weighmaster's license
 21    shall  be  issued  to  any  applicant for such license who is under the age of
 22    eighteen (18) or who has been convicted of any felony within five (5) years or
 23    has paid any fine or completed any sentence  of  confinement  for  any  felony
 24    within  five  (5)  years, or to any person whose license issued under this act
 25    has been revoked.

Amend Title 71, Chapter 4, Section 71-402 Idaho Code to eliminate
the language referring to conviction of a felony.  The amendment
will delete language that serves no real purpose and that has been
in the "Weighmaster's Licensing Act" since 1949 when the law was
first enacted.
