SESSION LAWS - Amends existing law to provide that Session Laws shall be
distributed in accordance with the list maintained by the Secretary of
State; and to provide that books distributed to officers in this state,
except legislative officers, are the property of the state and must be

                      BY JUDICIARY, RULES AND ADMINISTRATION COMMITTEE
                                                                        
  1                                        AN ACT
  2    RELATING TO DISTRIBUTION OF SESSION LAWS; AMENDING SECTION 67-906, IDAHO CODE,
  3        TO PROVIDE THAT SESSION LAWS SHALL BE DISTRIBUTED IN ACCORDANCE  WITH  THE
  4        LIST  MAINTAINED BY THE SECRETARY OF STATE; AMENDING SECTION 67-907, IDAHO
  5        CODE, TO PROVIDE THAT BOOKS DISTRIBUTED TO OFFICERS IN THIS STATE,  EXCEPT
  6        LEGISLATIVE  OFFICERS, ARE THE PROPERTY OF THE STATE AND MUST BE DELIVERED
  7        TO SUCCESSORS IN OFFICE; AND DECLARING AN EMERGENCY.
                                                                        
  8    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
  9        SECTION 1.  That Section 67-906, Idaho Code, be, and the  same  is  hereby
 10    amended to read as follows:
                                                                        
 11        67-906.  DISTRIBUTION  OF SESSION LAWS AND JOURNALS. (1) Immediately after
 12    the session laws are bound, they shall be delivered to the secretary of state,
 13    and the secretary of state shall distribute them within thirty  (30)  days  of
 14    receipt  from the printer in accordance with the list maintained by the secre-
 15    tary of state. as follows:
 16        (a)  To each department of government of this state, one (1) copy;
 17        (b)  To the library of congress, four (4), and to the state  library,  two
 18        (2) copies;
 19        (c)  To  the  senators  and  representatives in the United States congress
 20        representing Idaho, and to each of the justices of the  Supreme  Court  of
 21        this  state,  and  judges  and magistrates of the district courts, one (1)
 22        copy;
 23        (d)  To each member of the legislature of the session  when  such  session
 24        laws were adopted, one (1) copy;
 25        (e)  To the office of the attorney general, five (5) additional copies;
 26        (f)  To  the  legislature  in  sufficient number for one (1) copy for each
 27        standing committee of the house and senate;
 28        (g)  To the clerk of the district court of each county, sufficient  copies
 29        of the session laws to supply one (1) copy for the board of county commis-
 30        sioners, and one (1) copy to each elected county officer and to the public
 31        defender;
 32        (h)  To Idaho state law library, five (5) copies;
 33        (i)  To  each  state  and territory in the United States, one (1) copy for
 34        the use of the state law library;
 35        (j)  To each university or college law library sending to Idaho state  law
 36        library copies of its law review, one (1) copy; and
 37        (k)  To  the  University of Idaho, College of Law library, thirty two (32)
 38        copies.
 39        (2)  Immediately after the journals that are to be sold through the secre-
 40    tary of state's office are delivered to the secretary of state, the  secretary
 41    of  state  shall offer such journals for sale to any person at the price fixed
 42    for such journals by the printing committee as  provided  in  section  67-509,
 43    Idaho  Code.  Any  moneys  received by the secretary of state from the sale of

  1    journals shall be deposited in the general  account  in  the  state  operating
  2    fund.
                                                                        
  3        SECTION  2.  That  Section  67-907, Idaho Code, be, and the same is hereby
  4    amended to read as follows:
                                                                        
  5        67-907.  BOOKS DISTRIBUTED TO OFFICERS -- MARKING AS  PROPERTY  OF  STATE.
  6    The  secretary  must indelibly mark each book Books distributed to officers in
  7    this state, (except legislative officers), to indicate state  ownership.  Such
  8    books  remain  are  the  property  of  the state, and must be, by the officers
  9    receiving them, delivered to their successors.
                                                                        
 10        SECTION 3.  An emergency existing  therefor,  which  emergency  is  hereby
 11    declared to exist, this act shall be in full force and effect on and after its
 12    passage and approval.

Statement of Purpose / Fiscal Impact



                       STATEMENT OF PURPOSE
                           RS 10672C1
This legislation deletes the list of recipients to receive
Session Laws from the Idaho Code.  The addition of new language
indicates that the Secretary of State's office will maintain the
list of Session Law recipients.
                          FISCAL IMPACT
The total number of Session Laws printed will be reduced to 800
from 1200 sets resulting in a savings of approximately $13,500
per year.
