  1                                        AN ACT
  2    RELATING TO OFFENSES ON HIGHWAYS; AMENDING SECTION 49-709, IDAHO CODE, TO PRO-
  3        VIDE THAT A PERSON DOES NOT COMMIT THE OFFENSE OF UNLAWFUL SOLICITATION ON
  4        A HIGHWAY IF THE PERSON IS A FIREFIGHTER OR A VOLUNTEER FIREFIGHTER SOLIC-
  5        ITING DONATIONS FOR A CHARITABLE PROGRAM.
                                                                        
  6    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
  7        SECTION 1.  That Section 49-709, Idaho Code, be, and the  same  is  hereby
  8    amended to read as follows:
                                                                        
  9        49-709.  PEDESTRIANS  SOLICITING  RIDES  OR  BUSINESS. (1) No person shall
 10    stand on a highway for the purpose of soliciting a ride.
 11        (2)  No person shall stand on a highway  for  the  purpose  of  soliciting
 12    employment,  business  or contributions from the occupant of any vehicle, pro-
 13    vided however, that a person does not commit the offense of unlawful solicita-
 14    tion on a highway if the person is a firefighter or  a  volunteer  firefighter
 15    soliciting donations for a charitable program.
 16        (3)  No person shall stand on or in proximity to a highway for the purpose
 17    of soliciting the watching or guarding of any vehicle while parked or about to
 18    be parked on a highway.

  1                                AMENDMENT TO SECTION 1
  2        On page 1 of the printed bill, in line 13, following "person"  delete  the
  3    remainder  of  the  line; delete lines 14 and 15;  and insert: "may stand on a
  4    highway to solicit charitable contributions if authorized  to  do  so  by  the
  5    local authority having jurisdiction over the highway.".
                                                                        
  6                                 CORRECTION TO TITLE
  7        On  page  1,  in  line  3, following "PERSON", delete the remainder of the
  8    line; delete lines 4 and 5; and insert: "MAY STAND ON  A  HIGHWAY  TO  SOLICIT
  9    CHARITABLE  CONTRIBUTIONS IF AUTHORIZED TO DO SO BY THE LOCAL AUTHORITY HAVING
 10    JURISDICTION OVER THE HIGHWAY.".

                      STATEMENT OF PURPOSE

For several years the Professional Fire Fighters of Idaho have
raised money for charity through the "Fill-the-Boot" program, where
firefighters would receive funds from drivers throughout the state
of Idaho.  This bill is necessary to ensure the program does not
conflict with local ordinances or any other provisions of the Idaho
Code.
