  1                                        AN ACT
  2    RELATING TO THE SOCIAL WORK LICENSING ACT; REPEALING  SECTIONS  2,  3  AND  4,
  3        CHAPTER  166,  LAWS OF 2000; AMENDING SECTION 54-3215, IDAHO CODE, TO PRO-
  4        VIDE AN EXEMPTION FROM THE SOCIAL WORK LICENSING  ACT;  AND  DECLARING  AN
  5        EMERGENCY.
                                                                        
  6    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
  7        SECTION  1.  That  Sections 2, 3 and 4, Chapter 166, Laws of 2000, be, and
  8    the same are hereby repealed.
                                                                        
  9        SECTION 2.  That Section 54-3215, Idaho Code, be, and the same  is  hereby
 10    amended to read as follows:
                                                                        
 11        54-3215.  EXEMPTIONS.  Nothing  within this act shall be construed to pre-
 12    vent any person from doing work within  the  standards  and  ethics  of  their
 13    respective  professions or calling provided they do not hold themselves out to
 14    the public by title or description of service as being engaged in social  work
 15    practice.  Students enrolled in a recognized program of social work leading to
 16    a degree may practice only under the direct supervision of a certified  social
 17    worker  or  social worker licensed under this act. This act shall not apply to
 18    any employee of any facility licensed under section  39-1301(a),  Idaho  Code,
 19    section 39-1301(b), Idaho Code, or section 39-1301(c), Idaho Code, who is des-
 20    ignated  in writing to be responsible for that facility's social services pro-
 21    gram and who receives regular consultation from a qualified social worker.
                                                                        
 22        SECTION 3.  An emergency existing  therefor,  which  emergency  is  hereby
 23    declared to exist, this act shall be in full force and effect on and after its
 24    passage and approval.

                      STATEMENT OF PURPOSE

This legislation allows the continued use of social service 
designees in skilled nursing facilities and intermediate care 
facilities for the mentally retarded by removing the sunset 
mechanisms that are currently in law.  Without this exception, 
smaller rural facilities will be required to employ a Licensed 
Social Worker full-time at significantly increased cost.  This
 change will allow social service designees, when supervised by a 
qualified social worker, to continue to provide social services 
in these facilities.
                 	FISCAL IMPACT

Continuing use of social service designees will help avoid 
unnecessary increases in Medicaid expenditures in long-term care 
facilities.
