  1                                        AN ACT
  2    RELATING TO ASSAULT AND BATTERY; AMENDING CHAPTER 9, TITLE 18, IDAHO CODE,  BY
  3        THE  ADDITION  OF  A  NEW SECTION 18-916A, IDAHO CODE, TO PROVIDE A MISDE-
  4        MEANOR OFFENSE FOR OFFENSIVE CONTACT  WITH  A  SPORTS  OFFICIAL  DURING  A
  5        SPORTING EVENT.
                                                                        
  6    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
  7        SECTION  1.  That  Chapter  9,  Title  18, Idaho Code, be, and the same is
  8    hereby amended by the addition thereto of a NEW SECTION, to be known and  des-
  9    ignated as Section 18-916A, Idaho Code, and to read as follows:
                                                                        
 10        18-916A.  SPORTS  OFFICIAL  --  OFFENSIVE  CONTACT  -- MISDEMEANOR. (1) It
 11    shall be a misdemeanor offense punishable by imprisonment in the  county  jail
 12    for  a  period of time not to exceed six (6) months, or a fine of up five hun-
 13    dred dollars ($500), or both, in any action in which the state establishes the
 14    following:
 15        (a)  The accused intentionally subjected  a  sporting  event  official  to
 16        offensive contact;
 17        (b)  The  defendant knew that the victim was a sports official at the time
 18        the offensive physical contact was made;
 19        (c)  The offensive contact was made while the victim was within, or in the
 20        immediate vicinity of, a facility at which the victim served as  a  sports
 21        official for a sporting event.
 22        (2)  As  used in this section, "sports official" means a person who serves
 23    as a referee, umpire, linesman or judge or performs similar functions under  a
 24    different title at a sporting event whereat the public is invited and is prop-
 25    erly recognizable as a sports official.
 26        (3)  "Offensive  contact"  means body contact with the victim by laying on
 27    of hands; bumping;  pushing;  shoving;  spitting;  throwing  solid  or  liquid
 28    objects  intended  to  express  displeasure  or  inflict  harm; or an unlawful
 29    attempt, coupled with apparent ability, to commit  a  violent  injury;  or  an
 30    intentional,  unlawful  threat  by word or act to do violence, coupled with an
 31    apparent ability to do so; and doing some act  which  creates  a  well-founded
 32    fear that such violence is imminent.

The purpose of this legislation is to ensure the protection of
sports officials from "offensive contact" during sporting
activities by amending Chapter 9, Title 18, Idaho Code.
