|||| LEGISLATURE OF THE STATE OF IDAHO |||| Fifty-sixth Legislature First Regular Session - 2001IN THE SENATE SENATE BILL NO. 1108 BY TRANSPORTATION COMMITTEE 1 AN ACT 2 RELATING TO OPERATION OF RAILROADS; AMENDING CHAPTER 4, TITLE 62, IDAHO CODE, 3 BY THE ADDITION OF A NEW SECTION 62-403A, IDAHO CODE, TO REQUIRE RAILROAD 4 CORPORATIONS OPERATING IN IDAHO TO HAVE A CERTAIN NUMBER OF EMPLOYEES ON 5 EVERY FREIGHT AND PASSENGER TRAIN. 6 Be It Enacted by the Legislature of the State of Idaho: 7 SECTION 1. That Chapter 4, Title 62, Idaho Code, be, and the same is 8 hereby amended by the addition thereto of a NEW SECTION, to be known and des- 9 ignated as Section 62-403A, Idaho Code, and to read as follows: 10 62-403A. EMPLOYEES ON TRAINS. Every railroad corporation operating in 11 Idaho shall employ no fewer than two (2) employees on every freight train. 12 These employees are limited to a conductor or switchman/foreman and an engi- 13 neer who are qualified according to the rules and regulations of the federal 14 railroad administration of the United States department of transportation to 15 operate trains and locomotives. In addition, every passenger train shall also 16 have a fireman or assistant engineer who is qualified to operate the locomo- 17 tive.
