|||| LEGISLATURE OF THE STATE OF IDAHO |||| Fifty-sixth Legislature First Regular Session - 2001IN THE SENATE SENATE BILL NO. 1137 BY TRANSPORTATION COMMITTEE 1 AN ACT 2 RELATING TO GOLDEN STAR TRAFFIC ACCIDENT MEMORIALS; AMENDING SECTION 49-1316, 3 IDAHO CODE, TO PROVIDE THAT TRAFFIC ACCIDENT MEMORIALS SHALL NOT BE LIM- 4 ITED TO GOLDEN STARS, AND TO REQUIRE THE CONSENT OF THE NEXT OF KIN OF THE 5 DECEASED PRIOR TO PLACING A TRAFFIC ACCIDENT MEMORIAL ADJACENT TO THE SITE 6 OF THE ACCIDENT AND TO MAKE A TECHNICAL CORRECTION. 7 Be It Enacted by the Legislature of the State of Idaho: 8 SECTION 1. That Section 49-1316, Idaho Code, be, and the same is hereby 9 amended to read as follows: 10 49-1316. ERECTION OFGOLDEN STARS AS AMEMORIALS TO PERSONS KILLED IN 11 TRAFFIC ACCIDENTS. As a means of promoting safety upon the highways of this 12 state, the transportation department, the state police and other law enforce- 13 ment officers shall permit relatives or friends of a person killed in a traf- 14 fic accident upon a highway of the state, with the consent of the next of kin 15 of the deceased, to erect agolden startraffic accident memorial in memory of 16 the decedent. Thegolden startraffic accident memorial shall be erected adja- 17 cent to the portion of the highway where the accident occurred so that the 18startraffic accident memorial serves as a reminder that a fatality occurred 19 on that stretch of highway and that public safety will thereby be enhanced. 20 The transportation department shall promulgate rulesand regulationsto imple- 21 ment the provisions of this section, to providethesizea golden starlimita- 22 tions the traffic accident memorial must conform to and to retain jurisdiction 23 over areas wherethe golden starstraffic accident memorials are placed.
STATEMENT OF PURPOSE RS 11096 This bill changes what is allowed as a roadside memorial on state highways from a golden star to a memorial that is controlled by height, width, weight, and location in the right-of-way. Upon application to the Idaho Transportation Department, relatives or friends of a person killing in a traffic accident, with the consent of the deceased s next of kin, may erecta memorial. Rules of the department will identify the specific requirements of the program. FISCAL IMPACT There is no fiscal impact to the Idaho Transportation Department.
