  1                                        AN ACT
  2    APPROPRIATING MONEYS TO THE OFFICE OF THE STATE APPELLATE PUBLIC DEFENDER  FOR
  3        FISCAL  YEAR 2002; AND LIMITING THE NUMBER OF AUTHORIZED FULL-TIME EQUIVA-
  4        LENT POSITIONS.
                                                                        
  5    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
  6        SECTION 1.  There is hereby appropriated to the Office of the State Appel-
  7    late Public Defender the following amounts, to be expended for the  designated
  8    program  according  to the designated expense classes from the listed fund for
  9    the period July 1, 2001, through June 30, 2002:

 12    Operating Expenditures                                                 388,300
 13    Capital Outlay                                                           2,300
 14      TOTAL                                                             $1,236,100

 17        SECTION 2.  In accordance with Section 67-3519, Idaho Code, the Office  of
 18    the  State  Appellate Public Defender is authorized no more than thirteen (13)
 19    full-time equivalent positions at any point during the period  July  1,  2001,
 20    through  June  30,  2002,  for the program specified in Section 1 of this act,
 21    unless  specifically  authorized  by  the   Governor.   The   Joint   Finance-
 22    Appropriations  Committee will be notified promptly of any increased positions
 23    so authorized.

Consulting Services for Capital Cases: an additional $40,000 in ongoing operating expenditures to contract with attorneys for appellate work in death penalty cases.

Legal Secretary: an additional $41,500 in personnel costs and $2,300 for computer equipment and office furniture for a legal secretary position.
