  1                                        AN ACT
  2    APPROPRIATING MONEYS TO THE DEPARTMENT OF LANDS FOR FISCAL YEAR 2002; LIMITING
  3        THE NUMBER OF AUTHORIZED FULL-TIME EQUIVALENT  POSITIONS;  AND  INCREASING
  4        THE  LIMIT AUTHORIZED FOR FOREST PEST DEFICIENCY WARRANTS FROM $250,000 TO
  5        $4,000,000 FOR FISCAL YEAR 2002.
                                                                        
  6    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
  7        SECTION 1.  There is hereby appropriated to the Department  of  Lands  the
  8    following amounts, to be expended for the designated programs according to the
  9    designated  expense classes from the listed funds for the period July 1, 2001,
 10    through June 30, 2002:

 32        SECTION 2.  In accordance with Section 67-3519, Idaho Code, the Department
 33    of Lands is authorized no more than two hundred forty-seven and sixty-one hun-
 34    dredths (247.61) full-time equivalent positions at any point during the period
 35    July 1, 2001, through June 30, 2002, for the programs specified in  Section  1
 36    of  this  act,  unless  specifically  authorized  by  the  Governor. The Joint
 37    Finance-Appropriations Committee will be notified promptly  of  any  increased
 38    positions so authorized.
                                                                        
 39        SECTION  3.  The director of the Department of Lands, with the approval of
 40    the State Board of Land Commissioners, has declared a  zone  of  tussock  moth
 41    infestation  in  the  Moscow Mountain area and has estimated the costs of sup-
 42    pression and eradication to be between $2,000,000 and  $4,000,000.  In  accor-
 43    dance  with  Section 38-602, Idaho Code, the State Board of Land Commissioners
 44    may issue deficiency warrants against the General Fund to suppress and  eradi-
 45    cate forest pests. Because costs cannot be accurately determined at this time,
 46    the  limit  authorized in Section 38-602, Idaho Code, is hereby increased from
 47    $250,000 to $4,000,000 for fiscal year 2002. Costs for treatments  other  than
 48    to  state  lands  shall  be  reimbursed  according  to  cooperative agreements
 49    approved by the State Board of Land Commissioners.

The director of the Department of Lands has declared a zone of tussock moth infestation in the Moscow Mountain area.
