BY AGRICULTURAL AFFAIRS COMMITTEE
1 A CONCURRENT RESOLUTION
2 STATING FINDINGS OF THE LEGISLATURE AND REJECTING CERTAIN RULES OF THE IDAHO
3 DEPARTMENT OF AGRICULTURE GOVERNING BEEF CATTLE FEEDING OPERATIONS AND
4 RELATING TO ADMINISTRATIVE APPEALS, DEFINITIONS, NUTRIENT MANAGEMENT, DES-
5 IGNATION OF BEEF CATTLE FEEDING OPERATIONS AND AUTHORITY TO INSPECT.
6 Be It Resolved by the Legislature of the State of Idaho:
7 WHEREAS, the Legislature is vested with authority to reject executive
8 agency rules under the provisions of Section 67-5291, Idaho Code, in the event
9 that the Legislature finds that the rules are not consistent with legislative
10 intent; and
11 WHEREAS, it is the finding of the Legislature that certain rules of the
12 Idaho Department of Agriculture governing beef cattle feeding operations and
13 relating to administrative appeals, definitions, nutrient management, designa-
14 tion of beef cattle feeding operations and authority to inspect, are not con-
15 sistent with legislative intent and should be rejected.
16 NOW, THEREFORE, BE IT RESOLVED by the members of the First Regular Session
17 of the Fifty-sixth Idaho Legislature, the House of Representatives and the
18 Senate concurring therein, that IDAPA 02.04.15, Section 003, in its entirety,
19 relating to administrative appeals; Section 007, subsection 09, relating to
20 manure, subsection 17, relating to process wastewater, and subsection 18,
21 relating to runoff; Section 030, in its entirety, relating to nutrient manage-
22 ment; Section 040, in its entirety, relating to designation of beef cattle
23 feeding operations; and Section 050, subsection 03, relating to authority to
24 inspect, rules of the Idaho Department of Agriculture governing beef cattle
25 feeding operations, adopted as pending rules under Docket number 02-0415-0001,
26 be, and the same are hereby rejected and declared null, void and of no force
27 and effect.
STATEMENT OF PURPOSE
RS 11123
This concurrent resolution would reject pending rules of the Idaho
Department of Agriculture governing beef cattle feeding operations
and relating to administrative appeals, definitions, nutrient
management, designation of beef cattle feeding operations and
authority to inspect. The effect of this resolution, if adopted by
both houses, would be to prevent the particular agency rules that
are being rejected from going into effect.
FISCAL NOTE
This concurrent resolution has no fiscal impact.
