  1                                        AN ACT
  2    RELATING TO ANNEXATION OF LANDS  TO  IRRIGATION  DISTRICTS;  AMENDING  SECTION
  3        43-1010, IDAHO CODE, TO REQUIRE THAT AN ORDER OF THE BOARD OF DIRECTORS OF
  4        AN  IRRIGATION  DISTRICT CHANGING THE BOUNDARIES OF AN IRRIGATION DISTRICT
  5        SHALL BE FILED IN THE RECORDER'S OFFICE OF THE  COUNTY  WITHIN  WHICH  THE
  6        ANNEXED LANDS ARE SITUATED.
                                                                        
  7    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
  8        SECTION  1.  That  Section 43-1010, Idaho Code, be, and the same is hereby
  9    amended to read as follows:
                                                                        
 10        43-1010.  ORDER TO BE RECORDED. Upon a change of the boundaries of a  dis-
 11    trict becoming effective, a copy of the order of the board of directors order-
 12    ing  such change, certified by the president and secretary of the board, shall
 13    be filed for record in the recorder's office of each the county  within  which
 14    the  annexed  lands are situated, any of the lands of the district, and there-
 15    upon the district shall be and remain an irrigation district, as fully and  to
 16    every  intent  and purpose, as if the lands which are included in the district
 17    by the change of the boundaries as aforesaid, had been included therein at the
 18    original organization of the district.

The proposed legislation would require that an order of the
Board of Directors of an irrigation district changing the boundaries
of the district must be filed in the recorder s office of the county
within which the lands are situated.
