SENATE BILL NO. 1028

1 AN ACT
2 RELATING TO SCHOOL AGE; AMENDING SECTION 33-201, IDAHO CODE, TO STRIKE A MINI-
3 MUM AGE REQUIREMENT FOR ATTENDANCE IN SCHOOLS AND TO MAKE A TECHNICAL COR-
4 RECTION.
5 Be It Enacted by the Legislature of the State of Idaho:
6 SECTION 1. That Section 33-201, Idaho Code, be, and the same is hereby
7 amended to read as follows:
8 33-201. SCHOOL AGE. The services of the public schools of this state are
9 extended to any acceptable person of school age. "School age" is defined as
10 including all persons resident of the state, between the ages of five (5) and
11 who is less than twenty-one (21) years. For the purposes of this section
12 enrollment in kindergarten, the age of five (5) years shall be attained when
13 the fifth anniversary of birth occurs on or before the first day of September
14 of the school year in which the child is to enroll in kindergarten. For a
15 child enrolling in the first grade, the age of six (6) years must be reached
16 on or before the first day of September of the school year in which the child
17 is to enroll. Any child of the age of five (5) years who has completed a pri-
18 vate or public out-of-state kindergarten for the required four hundred fifty
19 (450) hours but has not reached the "school age" requirement in Idaho shall be
20 allowed to enter the first grade.
21 For resident children with disabilities who qualify for special education
22 and related services under the federal individuals with disabilities education
23 act (IDEA) and subsequent amendments thereto, and applicable state and federal
24 regulations, "school age" shall begin at the attainment of age three (3) years
25 and shall continue through the semester of school in which the student attains
26 the age of twenty-one (21) years.

1 AMENDMENTS TO SECTION 1
2 On page 1 of the printed bill, in lines 9 and 10, delete ". "School age"
3 is defined as including all persons resident of the state, between the ages of
4 five (5)" and insert: ". "School age" is defined as including all persons
5 resident of the state, between the ages of five (5)"; in line 11, delete "who
6 is less than"; and also in line 11 delete "this section" and insert: "this
7 section"; in line 12, delete "enrollment in kindergarten"; and following line
8 26, insert: "For a school district which conducts a prekindergarten program,
9 "school age" shall begin at the attainment of the age of three (3) years.".
10 CORRECTION TO TITLE
11 On page 1, in line 2, delete "STRIKE" and insert: "PROVIDE"; in line 3,
12 delete "SCHOOLS" and insert: "PREKINDERGARTEN IN SCHOOL DISTRICTS WHICH CON-
13 DUCT PREKINDERGARTEN".

3 IMUM AGE REQUIREMENT FOR ATTENDANCE IN PREKINDERGARTEN IN SCHOOL DISTRICTS
4 WHICH CONDUCT PREKINDERGARTEN AND TO MAKE A TECHNICAL CORRECTION.
5 Be It Enacted by the Legislature of the State of Idaho:
6 SECTION 1. That Section 33-201, Idaho Code, be, and the same is hereby
7 amended to read as follows:

STATEMENT OF PURPOSE

The purpose of this legislation is to amend Section 33-20 1, Idaho Code, by
sthking a minimum age requirement for attendance in schools.
FISCAL IMPACT
This bill will not have an impact on state or local funds, unless local School Board
Trustees decide to start new local programs for children less than 5 years of age.
These would be funded with local or federal funds.
