SENATE BILL NO. 1050

1 AN ACT
2 RELATING TO REAL ESTATE BROKERS AND SALESPERSONS; AMENDING SECTION 54-2020,
3 IDAHO CODE, TO INCREASE THE MAXIMUM FEE THAT MAY BE CHARGED FOR THE ISSU-
4 ANCE OR RENEWAL OF AN IDAHO REAL ESTATE LICENSE.
5 Be It Enacted by the Legislature of the State of Idaho:
6 SECTION 1. That Section 54-2020, Idaho Code, be, and the same is hereby
7 amended to read as follows:
8 54-2020. FEES. The Idaho real estate commission shall establish fees
9 which, in its discretion, are sufficient, when added to the other fees autho-
10 rized by this chapter, or any other law or rule, to raise that revenue
11 required to administer the provisions of this chapter.
12 Each person seeking any type of Idaho real estate license shall pay the
13 following fees, in addition to any other fees established in this chapter or
14 by rule:
15 (1) For each year or portion thereof for which an active or inactive
16 license is issued or renewed, a license fee in an amount not to exceed one
17 hundred fifty dollars ($1050), the exact fee to be determined by administra-
18 tive rule of the commission. Fees so established shall remain effective from
19 year to year unless changed through the rules promulgation process prescribed
20 in chapter 52, title 67, Idaho Code;
21 (2) A tuition or registration fee for real estate education courses,
22 course materials and any course exam fee. These fees shall be established
23 based upon the total annual costs involved in the provision of all real estate
24 education courses, course materials and course exam fees;
25 (3) A fee in the amount of twenty-five dollars ($25.00) for late license
26 renewal;
27 (4) A fee in the amount of fifteen dollars ($15.00) for any license
28 change that necessitates the printing of a new license certificate;
29 (5) A fee in the amount allowed by law for insufficient funds checks or
30 other types of insufficient payment;
31 (6) A fee in the amount of ten dollars ($10.00) for each certified copy
32 of a licensee's education history or license history;
33 (7) A fee in the amount of fifty dollars ($50.00) for issuance or renewal
34 of a branch office license.
STATEMENT OF PURPOSE
RS 10490
This bill would increase the maximum fee (the ceiling) that may
be charged for a real estate license, from one hundred dollars
($100) per year to one hundred fifty dollars ($150) per year.
The fee currently assessed by the Commission is at the statutory
cap, the level deemed necessary by the Commission to carry out
its essential operations. The Commission does not intend to
increase the actual license fees at this time. However, this
bill would authorize an increase in the future, if required by
the operational needs of the agency. The Commission is required
by statute to establish any new fee through formal rulemaking.
FISCAL IMPACT
None to the General Fund, as no general fund dollars are used by
the Idaho Real Estate Commission.
None to any political subdivisions, as Idaho Real Estate Commission
is funded primarily from license fees.
Fiscal Impact to Agency: None at this time. Based on 6,600 license
base, total potential annual fiscal impact $165,000. Any fee
increases would be in smaller increments over extended period of
time.
